Estafa case

I worked in one of the big insurance company here in the Philippines. Nagipit ako at nakagawa ng masama sa ilang plan holders ko. Tuwing magbabayad sila, nag iissue ako ng resibo pero di ko lahat nireremit,tinatamper ko ang duplicate nito. Ginawa ko ito dahil may loan shark ako na nautangan na sobra ang naging takot ko. Nang malaman ng kumpanya ko ang ginagawa ko, kinausap ako na aminin ang pangalan ng mga ginawan ko ng ganun bago nila ako ipakulong. May mga plan holder na 650 to 4thousand akong nagawan ng ganito at halos nabayaran ko na except dun sa iba na naiwan dahil hindi ako makatrabaho dahil di ako umaalis sa lugar kung saan naroon ang office na pinagtrabahuhan ko.humihingi pa po ako ng extention para mabayaran ko lahat lahat, kaso by monday ipapakulong na daw nila ako.alam ko po mali ang ginawa ko, akoy nakiusap na huwag ng humantong sa pagpapa pulis sa akin at inamin ko naman at hindi tinakbuhan, in fact aking binabayaran sa konting oras na binigay nila sa akin, ang problema lang dahil sa kawalan ng trabaho hindi ko mabigyan o madagdagan ang naibayad ko na. Maco consider pa po bang crime ang ginawa ko kung ako po ang umamin na, nagsimula ng mabayad, napahiya sa buong bayan namin, ngayon naman at ipapakulong pa?ano ang dapat.kong gawin? Maraming salamat po.

oo krimen yung ginawa mo. ang pwede mo lang gawin ay sumunod sa gusto ng kumpanya para di ka kasuhan or hayaan mo sila kasuhan ka. hindi obligado ang kumpanya na pagbigyan ka sa payment terms na kaya mo.

Makukulong din po ba agad ako bukas?kasi ang punto ko naman po ay sumusunod ako kahit na hindi na ako swesweldo pinilit ko pa rin ipasa ang collections xempre mabebenefit sila...

depende kung may arrest warrant na na nakaissue against sayo (yun ay kung may kaso na naisampa). if meron na, then anytime pwede ka damputin at ikulong.

do you already have a written agreement to the company that you will pay for the missing funds? you can use this as an argument that you now only have a civil liability no longer a criminal one, but I suggest you ask your relatives to take on loans so you can pay this off rather than face the risk of a criminal case

Yes atty. May mga pinapirmahan sila saken na mga promissory note at aking pinilit na maibigay sa kanila lahat sa date na iyon. Makikita ito sa dates ng pagpasok ng collections sa accounts ko.4 times na akong nakakabigay sa kanila ang gusto nila mapunoan ko na today.sabi ko nga po maliit na po ang naiwan ko,kinulang na lang ako sa oras dahil na rin sa kanila.pina area pa rin nila ako, pinagbenta ng life plan,ginawa ko dahil yun ang sinabi nila. Tapos ngayon sasabihin nila ikukulong na nila ako today dahil di ko nabayaran lahat. Alam na ng pamilya ko atty. Yung nangyari, sinabi ko na kahapon and gagawa sila ng paraan.pero hindi iyon mapu pull off agad agad within this week maybe.

Wala pa naman pong nai fa file na kaso dahil nakakabayad naman po ako kaya lang inilagay nila yung date before ng last date of payment.how long would they be able to file a case against me?at gaano din po ba katagal atty. Bago magkameron ng arrest warrant?

It's not instant that you can be arrested. they have to file a complaint at the prosecutor's office first and you have to be found liable.

Thank you so much atty.. Today is monday and I went to talk to them and gave some money that I have and the branch manager just said I have to start looking for a job. That's it. When in fact, last saturday she was furious and wanted me to be put behind bars as soon as possible. Maybe because she was with somebody, someone that doesn't need to be saying anything for the matter.

have your agreement reviewed by an attorney. it might be that your crime has now been extinguished because it was transformed into a loan

May nagastos din po akong pera ng kumpanya. pero inamin ko po lahat un. pinipilit po ako na bayaran ko po within 1 month hindi ko kayang buo hin ang 250k . pag di ko daw po nabayaran is kakasuhan nila ako ng estafa. Then i promised them na babayaran ko sila. yesterday i tried to get nbi but i have a hit. possibly po ba un ang dahilan ? wlaa pa pong 1 month bago ako umamin sa mga boss ko. thank you po

Update about my case. Yesterday I was asked again to report to the office to pay for the balance. I said I will have to bring the money tomorriw since I don't have it yet. The branch manager said, we will meet today in barangay and then to thr police station, is this the real process? Then I consulted an attorney in PAO he gave me a mediation paper saying we will meet with him on 23rd of January. Is this the real process? We will come into a mediation process? Or the police process?

the mediation process is a good idea. forget about the bgy and the police, those are scare tactics

Thank you so much atty..but the thing is.the branch manager told me that it should only between me and her. We should not tell anybody else or the attorney that I already consulted. Since I am paying everytime she asks me to. What should I do attorney? I am afraid that things will escallate even more if I told her that I have a letter from an attorney.

huh, is it possible that she is pocketing what you are paying?

I don't know atty...but i do have a piece of paper that she wrote i paid her 8thousand last friday. And I only have to another 8thousand(plus) next friday.. Before she wanted me to be put behind bars, she also said that she will hunt down my family in my hometown and put my face all over this town where I have been staying at because of my work with them. Then after my the conversation between my Aunt and a supervisor they all changed their minds that they will not put me behind bars anymore, I just need to pay. I am so confused at the moment atty... I don't know what to do next. Should I give them the mediation paper or just pay the balance and hope for the best. I have told my aunt about all the text messages and the calls that they have been doing to me. I told my aunt that I am terrified whenever my phone rings. One afternoon, they called and I let her answer the phone. The thing is, she's a pastora. I was with her when they had a talk about me. She just said I am trying pay and been obedient enough to do whatever they asked me to.eventhough they fired me last december 15 2017 they still needed me to finish the cut off so I worked until january 6 2018. My aunt also said that they are somewhat torturing me. Another twist in the story is that the supervisor whom the branch manager asked to call me said in the office that my Aunt and I threathen to kill them on which is impossible because my aunt never said anything like that. She is a pastora. She just asked for a little pity and patience and asked them for a prayer. I am really really dumbfounded that the supervisor said that, maybe to make me look bad and mad. I dont know. Please help atty... What should I do? Will I be put behind bars after paying all that? Even if I have lowered the amount that I stole from the company? I only owe them 8Thousand(plus). I put some of the money in the accounts of other people as well. Like in the new sales, or the accounts that will lapse. They need new sales everyday, and zero lapse (beyond 3 months of non paying) We have to put money on that for the good branch standing. When I calculate it, half of the money is there in the company. But she said, i have to pay it full and she will see what she can do to money I have put into other people's accounts to keep my area afloat. Am I still going to face stafa even I paid them? Will they put me behind bars this week?

Anyway, maybe what happened between my aunt and the supervisor doesn't matter to the court if I will be put into trial..but I am really exhausted with all the txt messages and the calls.. What should I do atty? Give them the mediation paper from PAO? I am not sure if I have the 8thousand for the balance this friday.. Is my case still a case afterall though I have paid some of the money? How much time do you think I have before they arrest me if I didn't pay them this friday... My family can help me again in paying the amount by end of the month,from their salary. But friday is on the 26th. Shall I tell them about the mediation thing? Or not?

so you've been paying all this in cash to the manager? no acknowledgment receipt? and tinatakot ka when you are delayed. i'm just concerned that the company is not aware of what the manager is doing.

ok, i recommend that you at least have a written quit claim and release form stating that all your obligations to the company have been fully paid and it be notarized after you give the last payment.

Thank you so much atty for all the advices you have been giving me.. I really don't know what to do.. All I know atty. Is the amount I supposedly stole. Then I am trying to pay it back when I have money. Twice a week I go there paying them. The question that still hunts me is, will I still be facing a criminal case if I didn't deliver the balance by friday? As I have said I can get the money a day after the end of the month. Will they file the case? What would the case be called if ever?

I just remembered that she didn't report me to the regional manager because they will handle my case differently. Like indirectly she's saying that she's doing me a big favor. She also said that they would have put me behind bars after learning what I did.

Padvise po sana ako, i was involve in a scam company..
Isa po akong ordinary member ng isang investment company na sabi nila ay nagttrade ng bitcoin.. ang company po ay walang registration at talagang risky magpasok ng pera..kaya naman sinubukan ko lang.. kumita ako ang malaki sa kumpanya hanggang sa napalapit ako sa pamunuan nila... dumating ang time na ndi na kaya ng bangko nila na magaccomodate ng deposit ng mga tao.. kaya naman hiniram nila ang bank account namin... hindi lang ako para pansamantala ay dun na muna magdeposit ang mga tao.. pagkatapos ay linggo linggo nilang winiwithdraw ang pera sa bank account namin... pero ndi kami nagkakaron ng kasulatan na narecv na nila ung cash na winithdraw sa banko namin... dumating sa point na hindi na nila kayang bayaran ang mga members... at nagreklamo na ang members.. walanv pinanghahawakan ang mga tao kundi ang deposit slip nila na pinadala sa bangko namin... personally ndi namin kakilala ang mga nagdeposit samin.
Ni ndi namin alam kung sila nga ba tlga ang kineclaim nila na nagdeposit sa bank account namin... dahil sa passbook wala naman nakalagay na depositor... ask ko po sana... may laban po ba kami dito? Kase pakiramdam namin.. kami ang pinakabiktima kesa s mga nawalan ng pera... hindi namn namin nakuha ung pera pero nasa amin ang sisi...mahigit 10 na tao po kami na hiniraman nila ng bank account... at ngayn lahat kami ay may subpoena.. may nauna nang dumating samin from nbi (though we are not really sure kung NBI ba talaga). And hindi po kami umattend... Then 2nd is from DOJ which is pinagiisipan namin kung pupunta kami... dahil may nagadvise namin na hintayin namin na umakyat sa RTC.. Hello good day! I would like to ask adivise about my case. Kindly advise me. I want to know if i can able to get a NBI clearance for the purpose of employment? But we have amecable settlement of the compliant.. and agreement that i can pay them partial everymonth.. but may worry is do i able to get NBI clearance even i have pb22 violation?
