Good day. Gusto ko po humingi ng advise since pumunta na po ako sa DOLE at di po sumipot sa unang hearing nmin ang management ng kabilang panig nuong jan 3 kaya sa jan. 10 na lang daw po ulet about sa ngyari sa salary ko since pera po ang pinaguusapan.
Bago po ako mapromote as Quality evaluator way back april 2, 2017 alam ko po na matatanggalan ako ng program allowance, walang OT or any incentives to get at dhil alam ko na po ang basic pay ko, di po ako tumitingin sa payslip. Nung November 24 coaching session ko po sa supervisor ko ngmmay email po ang HR sa supervisor ko na we are no longer eligible sa program allowance kaya sabi ko alam ko na po yan so I thought FYI lang na email. Nagkataon po nman paresign na ko nun so nov. 29 I submitted my resignation to my manager via email have it scanned since nakaleave supervisor ko. I was surprised December 1 pay out parang medyo magulo payslip ko may 8 program allowance showing deductions tapos meron ding prepayment offset na P18,275.94. Nung December 5, 2017 coaching session ko po ulet with my supervisor and manager may pinakita sa aking authority to deduct tapos tinanong daw ng supervisor ko ang HR dhil ngrerender na nga lang daw po ako. sabi daw ng hr sa final pay na ibabawas ang overpayment of allowance pero sabi ko i want to dispute kaya di ko pipirmahan ang authority to deduct. I don't want to suffer from someone's negligence so ngemail po ako ng dispute December 14 @ 10:44 am to HR cc supervisor, manager ko pati site director at VP ng company. Ng reply po ang site director same date 11:48pm kelan po ako pwede makausap to understand the issue and to seek resolution so i responded anytime ng Dec. 14 and 15 shift ko since off ko po ng dec 16 & 17 at naka terminal leave na ako pero siguro kabikabila ang meeting ay di na ako nareplyan. On my understanding my dispute is under review and I did not sign the authority to deduct, I was surprised seeing my online banking bakit mababa sweldo ko so ngcheck po ako ng payslip at nakita ko ngang may deduction P2,284.44. So that day Dec. 15 1:14PM ng email po ako ulet about sa ngyari sa pay ko diaputing na di pa ko ngsign ng authority to deduct so how come without my approval they deducted that amount on my salary. Around 7pm nakareceive ng call fiance ko from HR manager na gusto daw po ako makausap so pag gising ko po sinabi sa akin at pagdating ko po sa office Around 12MN sinabihan po ako ng supervisor ko na gusto po ako makausap ni HR manager pinababa po ako sa HR then ngusap kami. Wala daw po sila magagawa sa program allowance since kailangan ko sya ibalik sa company as overpayment at part ng contract ko na pinirmahan ay matatanggal ang program allowance. Sabi ko po "so ako lang po ang magsusuffer from someone's negligence kasi it's my miss on my part not checkimg my pay slip but it is the responsibility of the payroll department to ensure that we will get what we're supposed to be getting. Kung ginagawa po nya ng ayus ang trabaho nya it wouldn't have taken 8 mos. and that is 16 pay outs. Ngapologize ang HR manager on what happened at inexplain na dhil daw ngaudit kaya nakita at dahil hindi pa daw naka merge ang system ng HR sa payroll kaya manual ineenter sa payroll ang mga dapat matanggalan ng program allowance. Wala na daw pong solution dito but for me to pay it sa final pay. Sabi ko sige malinaw nyung naipaliwanag yan. eh panu nman yung kinuhanan nyo ko ng pera ng di pa ko ngauthorize. I think you crossed boundaries and this is something legal kasi wala nman pagkakaiba ito sa FRAUD. Wala pang napagusapan so paanu ngyaring ang payroll ay kumuha na ng pera sa sweldo ko. pinaghirapan ko yun lalo ngayun magpapasko at nakabudget na ko. Wala na daw po tlgang magagawa kaya sabi ko po manghihingi ako legal advise and we can discuss this outside legally. Sabi ng HR manager nasa akin na daw po yun pero bago po ako lumabas ng pinto sa nya "sana wag na tayu magkita sa DOLE".
humihingi po ako ng legal advise about sa ngyari sa akin bago pa man ito iendorse sa nlrc para po di ako blind sided sa batas at kung may laban po ba ako kasi ang sabi po sa akin sa DOLE ang nilabag daw pong batas ng kumpanya ay 2014 labor code advisory 11 wala po akong alam sa batas. Marami pong salamat.

1. hindi kailangan ng authority to deduct if mali talaga ang pag bigay sayo nung pera. as long as mapatunayan nilang hindi talaga sayo yun panalo sila sa kaso. ang only chance mo is to prove na somehow you really earned that money and mali ang pag tanggal sayo nung allowance
