hi good day ! ask ko lang po kng illegal po ung pagkakaterminate namin, my process nmn po , notice to explain 5 days then isang hearing lng terminated na kmi on the spot , pero during hearing po wala man lang evidence or proof na prinesent ung admin and hr sbe kasi nila nasa "boss" daw ung evidence na screenshots and pictures daw , pero wla nmn po pinakita til now, meaning ndi po documented ung evidence that time puro hearsay lng cnsbe nila wla nmn proof , pano po ba un ? and ung benefits nmin ndi pa din po nahuhulog ive been with the company for 1 yr wla pdn hulog ung benefits namin ;( salamat po sa sasagot

if you feel na illegally terminated ka, then go to dole and file a complaint. at least with DOLE, they can force the employer to show the proof they are stating.

Kung na-terminate ka on the spot, I don't think may due process ang pagkakasisante sayo. Di rin nasunod ang 2-notice rule na kailangan sundin kapag nagdidismiss ng empleyado. Try mo basahin to, baka lang makatulong sayo. https://www.alburovillanueva.com/dismissal-termination-employment
