Magtatanong lang po kung may illegal termination na nangyari at kung dapat may separation pay na nakuha.

My mom works in a call center, regular at magdadalawang taon na siya dun. Nastroke siya nung July 14, 2017. Hindi kami nagkulang at tumawag kami sa office niya to inform them na nastroke siya. Nakarating ito sa team leader niya at nagkausap kami. She told us na kelangan namin tumawag everyday, hanggat di nakafile ng LOA, para lang magsabi na absent ang nanay ko kahit na alam nilang nastroke siya. Dalawa lang kaming nag-aasikaso sakaniya, tita ko saka ako. Ofcourse di namin kayang magcommit sa pagtawag everyday dahil may trabaho rin kami at walang tulog sa pagbabantay, isama niyo na yung stress sa paghahanap ng pera. She was discharged July 21, 2017. It took us a few weeks para makahanap ng mag-aalaga for her para maasikaso na namin yung LOA niya at kung anong benefits pang pwedeng makuha. Sa few weeks na yun, ako lang ang nag-aalaga sakanya at ang tita ko naman ay busy sa work kaya walang makapag-ayos ng LOA niya.

Midnight nung Aug. 15, 2017 nagpunta ako sa office ng nanay ko. Pumunta ako sa HR to file the LOA pero ang sabi nung nasa HR, terminated na raw ang nanay ko dahil di raw nila alam na nagkasakit siya at hindi raw sila na-inform nung team leader niya. I doubt na hindi alam nung HR officer dahil nag-email pa nga siya samin nung mga forms na kelangan namin i-fill up with a note na magpagaling daw agad ang nanay ko. Nagpadala raw sila ng notice a week before na mateterminate na raw ang nanay ko pero wala kami natanggap. Since terminated na raw, we went on with the exit interview. Binalik ko yung mga hinihingi niya at binalik niya sakin yung laman ng locker ni mama. Na-clear naman siya kaya binigyan ako ng sched kung kelan makakakuha ng backpay at certificate of employment.

Hindi ko po alam kung tama ba na ganun ang nangyari or illegal termination ito. Nakatanggap po kami ng backpay(with holding tax and 13th month) pero walang separation pay. Napilitan at labag po sa aking kalooban yung termination na nangyari  pero kinelangan ko pong lunukin para maprocess ko yung SSS benefits ng nanay ko.

it is only illegal termination if they did not observe due process which is notice to your mother about the probable violation of the CoC (Absences - AWOL). This notice is usually included in a Return To Work Order. And lastly notice of decision / termination. In case that the employee is not reporting to work (like in the case of your mother), the employer must prove that they sent both notice to the last known address of your mother. this can be proven by registered mail.

Next, what kind of separation pay are you thinking about? terminated employees are not entitled to one.
