Hello Atty.

I am an HRP and my question is can i terminate a Security manager for violating abuse of authority? The incident is like this, he verbally suspended security guard which is a 3rd party employee without the knowledge of HR and CEO and without due process.
This is his second violation for the calendar year. Do i have the grounds because he also violated the labor code for illegal suspension. right?

His first violation was betrayal of trust that was supposed to be for dismissal but instead was given warning.

for a manager, i would focus more on loss of trust and confidence. to be honest, i am not fully convinced that it should be considered a terminable offense unless it can be shown that he knew and disregarded labor laws. (not he should have known)
