Hi po, itanong ko lng po sana if ano ang dapat gawin para mapa separate title ang isang portion ng lupa?

Merun po iniwan ang lola ko na lupa sa mga anak nya at isa dun ang mama ko. merun na po syang survey ng geodetic and permado na din po ng engineer, kaso until now ni isang partition ng lupa wala pang sariling title mother title pa din sya. gusto ko po sana pagawan ng title yung sa portion ng mama ko. ano po ba ang dapat namin gawin?

isa pang problema namin is yung mga kapatid ng mama ko is hindi nila gusto ma buwag ang title but we decided na e separate na yung sa mama ko para in the future di na magkakagulo at di na kami mahirapan.

Suggestion ko po makipag usap kayo sa Register of Deeds na sumasakop sa property nyo. Pakita nyo ung lot plan na ginawa ng geodetic engineer (dapat po dumaan na yan sa LRA).

Tanong nyo sa RD ano ang requirement para subdivide ang mother title.

Para ma-partition ang lot into smaller, individual lot titles, kailangan po maisubmit ang request nyo sa RD, together with the original title, and the technical description and the subdivision plan.

Mahirap mapartition ang isang lot lang, sabay po yang sinasubmit sa RD.

@ Georgitakapostol , una please check kung yung survey plan by the geodeticEngineer is already approved by DENR or LRA, kung approved na dapat ay meron kang Sepia print and Technical Description from approving body then along with other documents such as, partition agreement, Extra- Judicial settlement with waiver of rights, owners copy of title, CAR from BIR, etc. then pwede mo na ipahati yung title . Please note that Extra - Judicial settlement requires conformity of heirs ,aliban kung may dokumento na nagsasalin sa inyo directly like, deed of sale or deed of donation.
