Hi sir/maam. I would like to ask for any suggestion regarding my case with NLRC. I hope you can help me. I was dismissed by my previous employer last Aug 15, 2016. I've been with them for 2 years and 9 months. Last July 31, 2016, I sent a text message to my Team Captain, Operations Manager and Workforce informing about my absence which is normally the protocol. I continue doing that during my absence. On the 15th of August I sent a text message to my Team Captain asking for my schedule. My TC called in and told me I dont have any schedule because she terminated me effective on that same day. She told me I was supposed to receive an RTWO notice (return to work order)which they sent last Aug 3, 2016. I told her I have not received any and besides why would she terminate me. I have been sending them text messages that I was sick and I have a medical certificate. My TC replied "Mommy please understand that I have a score to take care of" Then on the 22nd of August, the RTWO notice was delivered to me. To cut the story short I filed a case with NLRC for illegal dismissal so we submitted Position Letters. My lawyer was from PAO. I presented all the documents to my lawyer to prove that I was really sick during the time I was out. I even have the text messages printed out but the lawyer said to keep the documents including the med cert. She just submitted the receipt from LBC which I acquired to prove the date of the delivery. It was sent out Aug. 20 and I received it on the 22. Which means I was already terminated when they sent the RTWO notice. So the case went on. The 1st decision was to reinstate me but the company did not agree with the decision. On their last reply the company said that I did not pass any med cert. So. another decision came out and it stated that the reinstatement was dismissed. I told my lawyer that I have a med cert. She said if I want to continue with the case I have to go to the main office of Dept. of justice in QC? and I cannot submit the med cert and the printed out text messages anymore. I remember my lawyer asked me before the second decision came out, " Do you still want to continue with this case? anyway you already have a job?" That's the most stupid question I heard coming from a lawyer. I am sorry. Sir/Maam is there any chance that I can push through with this case. I know I was illegally dismissed. I have not given any chance to explain, no admin hearings, just one notice and that's it. No chance to present my med cert as well. I hope you can give me advises. Thank you for reading my letter.
