Hi sir/maam. I would like to ask for any suggestion regarding my case with NLRC. I hope you can help me. I was dismissed by my previous employer last Aug 15, 2016. I've been with them for 2 years and 9 months. Last July 31, 2016, I sent a text message to my Team Captain, Operations Manager and Workforce informing about my absence which is normally the protocol. I continue doing that during my absence. On the 15th of August I sent a text message to my Team Captain asking for my schedule. My TC called in and told me I dont have any schedule because she terminated me effective on that same day. She told me I was supposed to receive an RTWO notice (return to work order)which they sent last Aug 3, 2016. I told her I have not received any and besides why would she terminate me. I have been sending them text messages that I was sick and I have a medical certificate. My TC replied "Mommy please understand that I have a score to take care of" Then on the 22nd of August, the RTWO notice was delivered to me. To cut the story short I filed a case with NLRC for illegal dismissal so we submitted Position Letters. My lawyer was from PAO. I presented all the documents to my lawyer to prove that I was really sick during the time I was out. I even have the text messages printed out but the lawyer said to keep the documents including the med cert. She just submitted the receipt from LBC which I acquired to prove the date of the delivery. It was sent out Aug. 20 and I received it on the 22. Which means I was already terminated when they sent the RTWO notice. So the case went on. The 1st decision was to reinstate me but the company did not agree with the decision. On their last reply the company said that I did not pass any med cert. So. another decision came out and it stated that the reinstatement was dismissed. I told my lawyer that I have a med cert. She said if I want to continue with the case I have to go to the main office of Dept. of justice in QC? and I cannot submit the med cert and the printed out text messages anymore. I remember my lawyer asked me before the second decision came out, " Do you still want to continue with this case? anyway you already have a job?" That's the most stupid question I heard coming from a lawyer. I am sorry. Sir/Maam is there any chance that I can push through with this case. I know I was illegally dismissed. I have not given any chance to explain, no admin hearings, just one notice and that's it. No chance to present my med cert as well. I hope you can give me advises. Thank you for reading my letter.

medyo magulo yung specifics ng kwento mo. but i think you need to file an appeal. if yung motion for reconsideration period is over na. i would suggest that you consult a lawyer for the filing

kelangan patunayan ng kompanya na nagpadala sila. di nila kelangan patunayan na natanggap mo. pero wala nang saysay yang mga yan. ang kelangan mong alalahanin ay makapag file ka before matapos yung period for filing

It doesnt make any sense po, kung papatunayan lang nila na nag padala sila, kasi kaya nga po db ginagamiit na elements of notification ang RTWO, eh, for Formality pero hindi po db dapat mapatunayan din nila na natanggap ko po yung letter? then go from there?

tyka po sir, hindi po ba ang RTWO ang pinapadala lang po kpag hindi na nag nonotify si employee kay employer? kasi po saken nag nonotify po ako, the whole 2 weeks na hindi ako nkpasok and then all of a sudden malalama ko sinendan daw po ako ng RTWO na hindi ko naman nattanggap. is it legal to file for an illegal termination?

ang return to wotk order ay ipinadadala sa employee na hindi pumapasok. kelangan alng nilang patunayan na pinadala nila ito sa address ng employee. hindi nila kelangan patunayan na natanggap ng employee ito kasi if umuwi ng province or sa ibang address ang empkoyee hindi tungkulin ng employer na hanapin kung nasan ka na.

based on the limited data na you mentioned. it sounds like they did not follow due process, which is grounds for damages.

May medical certifiicate po ako sir na nag papatunay na may advised po yung absences ko, so all of a sudden nagulat nlang po ako nag sesend na sila saken ng RTWO, and regular din po ako nag nonotify sa workforce nila, hindi naman po ako nag ask ng anything gusto ko lang po malaman kung ano po yung rights ko, at ano po yung mga possibility na pede mangyare.. thanks po..

Thank you po sa reply. Eh sir/maam pwede pa po ba ako mag consult sa ibang lawyer from PAO? Kase po nung tinext ko yung lawyer na naghahandle ng case ko sabi po nya within 10 days lang daw po ang reply. eh sobrang lampas na po ng 10 days kase from Sta. Cruz Laguna po ako tapos sa may Manila City hall po yung PAO office. Hindi po ako nakapunta sa kanya kase may pasok din po ako. Ganito po kase ang nangyari. yung una pong desisyon ay reinstatatement pero sinagot po ng kabilang panig yun. Sabi po nila wala daw po akong Med Cert at no proof na nagnotify ako about my absence. Nung time po na yun meron na po akong bagong work kase sabi ng lawyer ko maghanap ako ng trabaho kase aabutin daw po ang kaso ng 6 to 1 year. So sinunod ko po sya. Nung lumabas po yung unang desisyon which is reinstatement, sabi ng lawyer kung itutuloy ko pa ba daw ang kaso, eh may trabaho na daw po ako. Sabi ko po itutuloy ko. Hindi naman nya ako pinagawa ng reply dun sa desisyon kase panalo daw po ako. Eh sumagot po yung kabilang panig ayaw pumayag sabi po nila na wala daw po akong med cert at proof na nagnotify ako about my absence. Nung lumabas po yung pangalawang desisyon dismissed po yung reinstatement. Sabi ko po sa lawyer kung med cert at notification ng absence ko ang hanap nila meron po ako nun. Pero hindi po inattach ng lawyer ko as evidence. Yung receipt lang po ng LBC at RTWO ang inattach nya sa unang position letter. Sabi po ng lawyer ko kung mag a appeal po ako sa pangalawang desisyon kelangan ko pumunta sa main office ng DOJ sa east avenue? at hindi ko na daw po pwede isubmit ang med cert at proof ng notification? bakit po? thank you po.

i dont know regarding pao. but you should consult a lawyer as soon as possible. unfortunately if 10 days talaga and you missed it na, wala ka nang magagawa.
Question lang, if meron ka nang trabaho and reinstatement ang decision, ano ang gusto mong mangyari? aalis ka pa ba dun sa pinapasukan mo ngayon para bumalik sa dating employer mo? I think yan yung punto ng abogado mo

Sa totoo lang po ayoko na bumalik kase baka magkaroon lang ako ng problema sa company pero ang hindi ko po matanggap yung nawala ako sa "account" na kinabibilangan ko. Napakaganda po kase ng account na yun. Napakahirap na po pumasok sa ganoong account. At hindi ko po matanggap na tinanggal ako ng hindi man lang naipagtanggol sarili ko. mag ti three years na ko sa company na yun at wala akong kabalak balak na magresign or leave the company. Tapos nagisimula na pong magimprove ang mga task ko. May possibility at opportunity na po ako na makapagapply ng higher position. At bukod sa napahirap ng magaplay ng magaplay. Hindi man lang nila ako binigyan ng pagkakataon na maipresent ang med cert ko. parang lumalabas na sinungaling pa ako. Pano po kaya gagawin ko? Meron po ba akong ibang department na malalapitan?

wag mo na munang problemahin yan. ilapit mo na kaagad sa abogado kasi limited ang time mo para mag reply or ask for reconsideration. once na nag lapse yun eh cased closed na yan

bakit ba di mo ibinigay yung medical certificate nung absent ka? di ba dapat 3 days na absent required ka na na magsubmit ng medical certificate kahit di ka nakapasok? dapa inimail mo lang sana sa boss mo, yun ang point ng employer, di ka man lang makipagcommunicate ng maayos, ano ba naman yung text, they wanted more

yun ang possible na fault mo kaya mahihirapan ka na maipanalo yan. pero I think entitled ka pa rin sa due process na di nila nasunod.

i have a question re illegal dismissal cae. malaki ba factors yung mga events na nangyari pagkatapos na terminate si employee? ganito kase yun, di ba naterminate si employee na walang due process so nagcomplain sya sa nlrc. so may submission ng position paper. sa side ni employee, nagconcentrate sya sa legal process ng pagterminate ng emplyee while si respondent nagconcentrate sya sa mga events after nila naterminate si employee. mga afterthought ba.
yung isa nilang ibinigay it was obvious na wala talaga kinalaman sa immediate termination ni employee totally unrelated sa event. kung baga parang off topic
