hello! good afternoon. I just need some very important legal advices regarding my employees wages and 3th month pay.

for almost 2 years, none of my employees have signed contract sa company na pinapasukan namin ditto sa bulacan. binabayaran naman sila ng Minimun wage and that is so fine kasi magaan naman ang trabaho. my concern was just, lahat kaming empleyado *hindi nag sign ng contract. *walang binabayarang benefits. *walang wage adjustments. *and walang proper computation ng 13th month pay.

itatanong ko na din sana yung tungkol sa mga employees na wala pang 6 months sa company. maisasali ba sila sa mga babayaran ng 13th month pay this coming December? nung kinausap ko kasi yung general manager namin about ditto ang sabi lang nya; "kapag sinabi na kasama, edi kasama. kapag sinabi na hindi, wala na tayong magagawa."

ano po bang habol ng mga co-workers ko about sa mga bagay na to?

Kung nag work na kayo ng 2 years, with or without contract, it is deemed regular ka na on your 6th month and 1 day.

13th month pay is a mandated benefit. as long as the employee worked sa company ng 1 month, the employee is entitled to a pro rated 13th month pay.

tell your GM or owner that if they don't observed this, besides paying the employees their 13th month pay, they will also be penalized for this.

what if verbal agreement lang yung naging employment? as in, walang any paper na napirmahan tapos walang requirements na naibigay? ang sabi kasi withing 3mos lang yung probationary period ng mga co-workers ko. then after nun automatic regular na daw pero base pa din sa performance nila. kaso wala naman din evaluation na nangyayari.

actually, ako yung first administrative staff nila, concern ako for the both parties, syempre dahil na din sa pareho kaming nakikinabang sa isa't isa. ayoko naman na magkaroon ng case sa dole yung employer ko and lalong ayoko naman din na malugi yung mga co-workers ko Lalo na't kung anong kapakinabangan nila, ganoon din yung makukuha ko.
any advices for my concerns?

basta nasa batas, pag pumasok ang employee 1 day after 6 months, regular na siya. it doesnt matter if there is a contract or not. it doesnt matter if there is an agreement after 3 months, (lalo na kung di na enforce ang agreement).

Just treat those employees as regular employees and have security of tenure. also they are entitled to all mandated benefits stated by the government.

thanks! but what if hindi na-implement yung mga benefits ng employees? ano yung mga possible cases na pwedeng I-sue sa employer?

just report them to SSS, PHIC and HDMF, and the agencies themselves will take care of the employers
