good day po.

hingi lang po ako ng advice kung ano pede kong gawin action.
binenta po kasi ang bahay at lupa sa halagang 1.5M pero 600K pa lang ang initial payment ng nakabili at wala pong title dahil di pa nakarehistro sa nagbenta ang property. okay naman dun sa nakabili dahil binigyan sila ng karapatan na tumira sa bahay. at karapatang maningi sa nangungupahan doon.
hindi po kami ang may-ari ng bahay, pinatira lang po kami dun ng matandang may-ari ng bahay.kumbaga parang caretaker/representative nya.
ang problema,lumipas na ang 10yrs di pa rin po fully paid ang nakabili at sabi nya babawiin na lng daw nya ang binayad nyang 600k plus may interest pa daw. pinapaalis na rin kami ng nakabili sa bahay. dahil wala raw kaming karapatan dun.
hindi na rin po kasi umuuwi ang matandang babae sa bahay. pero nakakausap pa nmin thru phone.

ano po ba pede gawin ng matandang babae (na may-ari ng bahay)? aalis po ba kami? may karapatan po ba ang nakabili na magtake over sa bahay kahit hindi pa siya fully paid? salamat po.

If there is no reservation ownership pending full payment then the house belongs to the buyer.

The recourse of the seller is to go to court and collect or in the event that she can no longer collect ask that the house be sold to pay the purchase price if that is the only property of the buyer.

hindi rin po kasi nmin alam kung ano napagkasunduan nila nung nagkabentahan at nagkabayaran..,kung sakali ba, pede ba kami bigyan ng SPA ng seller para kami na po magasikaso?matanda at maysakit na rin po kasi ung may-ari. thanks.
