Hi, Paano po ba masasabing illegal suspension?

We have an employee and he complaint that he was under illegal suspension.

The scenario goes like this:

Nakipagsagutan siya sa isang empleyado namen. Tinamaan yung policy sa Handbook namen.

Sec 5.02 Uttering words, doing acts, or making gestures to a superior which are manifestly or insulting, or grossly disrespectful to the latter.
(Pagbigkas ng mapanirang salita, gawa o kilos sa kapwa empleyado o nakatataas na hayagang pagpapakita ng insulto pangkalahatang kawalang ng respeto sa nabangggit.

7-15 days suspension yung SANCTION for that.

He complained to NLRC for illegal suspension.

Kung wala ang mga yan, masasabing illegal ang suspension.

Yes po, may NTE and Memo of Suspension po na binigay sa kanya ang HR Dept. Pero ayaw po niyang tanggapin eto.

Kailangan po ba ng investigation pa po? kahit po rinig po ng lahat yung pakikipagsigawan niya po sa supervisor niya?

Gumawa po muna ng IR yung visor nya, bago po nagbigay ng NTE kay employee. After po nun sinerved sa employee pero ayaw po niya ireceived.

Notice to Explain and Preventive suspension po yung binigay sa knya, then pinauwi din po siya nung time na yun since galit na galit na siya at nakikipagsigawan na po siya sa visor niya.

bakit meron preventive suspension? pag sigawan ba ay threat to person na? baka yun ang complain niya, kung threat to the supervisor, dapan na explain ninyo maigi sa kanya bakit siya na preventive suspension. kung na misundertood ng empleyado yan, tiyak kala niya na sinuspinde agad siya kahit hindi pa siya nag explain ng kanyang side.

hindi po yun na po yung pinaka suspension niya po. tapos hndi na po siya pumapasok.

kung justified yung preventive suspension niya, walang illegal suspension.

preventive suspension should only be given to employees if they is a threat to person and to property. You need to justify that the employee is really a threat to the supervisor.
