From what I know, based on my past work experiences, incentives are taxable. Lalo na pagdating sa sales account, minsan mas malaki pa ung tax sa basic salary kasi sinasama sa regular salary ung incentive payouts. But dun sa last work ko, cold cash nila binibigay ung incentives, as in real time. Bukod pa sa weekly and monthly incentives. And, of course, nakabase lahat ng incentives sa sales ng agent. Nakakapagtaka lang kasi sobra sobrang dami nilang magbigay ng incentive and ni minsan never nila ininclude sa salary yun. Walang natatax-an for the incentive. Is this even legal? I could go home minimum of 500 cash per day. Incentive pa lang yan. Bukod pa ung weekly incentive and monthly. Lahat ng incentives cold cash binibigay. Bukod pa ung mismong salary ko every 15th and 30th of the month. Umalis ako dun kasi on my 6th month, ndi agad nila mapakita ung regularization paper, which I had been reminding them about on my 5th month pa lang. Kahit malaki ang kita don, nakakatakot kasi parang scam. Where do I go to and who can I talk to para maaksyunan ung company na yun? Nasisilaw ung mga tao sa pera without even knowing kung legal pa ung company and even ung ginagawa nilang trabaho?

the penalty for not with holding is that they cannot use the salary as an expense. my guess is hindi talaga nila ginamit as expense kaya walang SSS etc. if you really are hell bent on complaining about them to the BIR, make sure lang to pay taxes on the incentives before you conplain. you are liable for that.

Hindi ka ba binabayaran for your benefits as Sir Council mentioned liked SSS, Philhealth and Pag-ibig?

If hindi, that means meron na violation ung employer for not registering to those government agencies and they can close that if proven they are not registered.
