Arresto Menor

I want to file RA 9262 for my former live in partner, we have one child. is it considered rape if i resist and he does it when he have a heated arguement and when i am crying and emotionally breakdown at the moment? i felt harassed. and it happendes months ago. can i state this on my file?

do you mean you did not give your consent and he still forced himself to have sex with you? then yes it can constitute as rape.
