Yung batas po na termination due to sickness ano po ba covered nun
kasi more than 10 years na po ako sa company

tapos ngayong 2017
nagkasakit po ko ng diabetes at naactivate po yung TB ko
my TB n po ako before almost every year ako nagppasa ng sputum analysis negative po yun


Ngayon po ng positive sya. Pag tinanggal po ba ako bigla ng employer ko may makukuha po ba ko na separation pay marami po salamat[b][b]

in the labor code, Employment may be terminated for the following authorized causes:

1. Introduction of labor-saving devices
2. Redundancy
3. Retrenchment
4. Closure or Cessation of business
5. Disease the employee found to be suffering and whose continued employment is prohibited by law or is prejudicial to his health as well as the health of his co-employees.

As such, separation pay must be paid when the termination is based on the above-mentioned authorized causes except when the closure of the company is due to financial losses.

However, this must be validated by your company certified physician. You are entitled to a separation pay if you are terminated in this manner.

Just to make it clear, if ni terminate ka dahil ikaw ay may sakit entitled ka sa separation pay. pero kung sabi sayo ng doctor ay wag munag pumasok at ikaw ay tatanggapin parin pag ikaw ay magaling na. hindi ka entitled. in other words if your company terminated you bec of fisease meron. if ikaw ang ayaw dahil sa kalubhaan hindi ka entitled sa separation pay

To be validly terminated by reason of disease or illness, dapat certified na hindi ka kayang gamuting within 6 months ng isang public health authority, hindi ng company doctor (lang). Meron na tayong mga rulings to that effect. Kaya kung walang certification mula sa public health authority tapos bigla ka nila tanggalin, you can complain for illegal dismissal.
