Hi po I need an advise about my condition. I have a 7 yrs old son and we're not married with his father but he carries his dad's name. My son is currently living with his grandparents on his father side because they dont want to give my son to me. But Im always visiting him at least 2x a month. I have a successful job as a banker. My son is in Pampanga and I live with my parents in Laguna. His dad is working abroad. So its only his grandparents whos been taking care of him. I took care of him from childbirth until 1yr old. Then I returned to my parents in Laguna because I need to get a job to support my family and my son. I cant bring my son with me because they dont want to give my son to me. My question is do I have a right to get my son? My sons been crying everytime im leaving him and I cant take it anymore. But his father doesnt want to give my son to me. Please help me thanks.

Since the child is illegitimate. The custody of the child belongs to you alone (the mother). Ask for dswd for help. The father has only visitation rights. For him to have custody, it should undergo thru court. And from your statement there is no reason for the court to remove the custody from you.

Hire a lawyer and file a petition for custody and habeas corpus.
