Hi Atty. Good evening. Im so happy nakakita ako ng ganitong site. Sana matulungan niyo po ako.

Regarding po sa transfer ng bahay ng lola ko. Nagpapatuong kasi ang uncle ko (W) sa pagtransfer. Sa kanya po talaga ang bahay pero pinangalan niya lang sa lola ko kasi before po wala siya kahit anong id. Eh need po yun sa pagibig kaya sa lola ko muna naka pangalan. Ngayon po 85yrs old na si lola and gusto sana ng uncle ko na mattransfer ang property sa youngest niyang kapatid (N) before po mawala ang lola ko. Gusto niya po sana mangyari na if malilipat kay 'N', lahat ng kapatid at mga apo walang habol dun sa property in the future para di magkagulo if ever.

Ano po ba ang pinaka best na gawin? Kasi sabi ng isang kapatid donation daw. I donate ng lola ko sa youngest pero posibleng may habol pa rin daw un kasi donate lang. Isang lawyer naman po nagsabi extra judicial pero may pirmahan lang pag wala na si lola ko. Isa po deed of absolute of sale nalang daw para may pirmahan ng mangyari na.

Please i need your guidance and expertise on this matter atty. Kasi di namen alam ang repercussions ng mga gagawin docs ng pag transfer.

for now, your options would be thru sale or donation since your lola is still alive. May difference yung dalawa in terms of the percentage of taxes wherein you may save money thru a lower tax rate depending on the value of the property. But indeed donation might be questioned later by other heirs of the lola, although in reality the property is actually owned by your uncle. If you want spare your uncle from potential hassle in the future, the best best option would be thru a deed of sale.
