Separation Pay and Retirement Benefit

Good Day po magtatanong lang po sana ako ilang months po ba ang processing ng separation pay at retirement benefit ng isang empleyado na nagresign sa kanyang dating company? April 15 po ako nagresign pero hanggang ngayon wala pa po akong natatanggap sabi lang po ng hr namin pinaprocess nila but since this is the first time that they will be processing such claim hindi nila ako mabigyan ng time frame as to how long will I have to wait before my compasation can be released they said that they will just update me from time to time medyo mahirap naman po magantay ng hindi mo alam kung gaano aang pagaantay mo. nag resign ka or tinanggal? Pag nagresign ka walang separation pay unless meron kayong CBA. Or nagfile ka ba ng retirement?

resigned po ako, no need to file for the retirement daw po tinanong ko kasi kung may dapat ako ipasa o gawin wala daw po ipoprocess daw po nila wala nga lang time frame kung hanggang kelan

Ang problema if nag resign ka before retirement age, hindi obligado ang companya na bigyan ka ng retirement pay. Kaya hindi mo sila ma complain

meron pong program yung dati naming office na early retirement of 10 years na comply ko naman po yun kaya sinabi nila na meron ako makukuha yun nga lang hindi nila alam pa kung kelan marerelease kasi kakaapprove lang wala pa daw pong policy and procedure na nagagawa kaya maganatay antay lang daw po

since this benefit is a company prerogative, wala kang magagawa kundi antayin na lang kasi wala ka habol legally para mapadali ang process. nasakanila kung pano nila prapriority yung pag asikaso ng terms and guideline ng benefit na to. hindi mo din pwede compare sa ibang company yung time frame since nga yung benefit na hinahabol mo ay hindi naman as compliance with the law.

Kung resigned ka, wala tayong processing time na pag-uusapan, kasi hindi ka entitled sa separation pay. Yung mga tinanggal lang ng company involuntarily by reason of authorized causes of termination ang mga entitled sa separation pay. Good day, tanong ko po if ano ang rule ng compensation para sa redundancy or separation pay? Kuwento ng pinsan ko magsasara na ang company na pinagtatrabuhan na niya ng 3 taon. Ang portion ng sahod niya nakasaad as bonuses sa kontrata niya. So bukod sa basic, merong

basic salary lang po ang computation nang redundancy/retrenchment pay.. unless stated sa contract nya or CBA nang company.
