Arresto Menor

Mga ma'am / sir, pahelp po.

May bago kasi kaming lilipatan. Long story short, yung mga kapitbahay (squatter), pinariringgan kami madalas everytime na dadaan kami.

Tas nung sunday, before ko buksan gate namin, napansin ko yung YALE padlock namin, may nakasuksok na safety pin na malaki. So ang ginawa namin ng mother ko, pina blotter namin sa barangay pati sa presinto sa makati.

Tas yung isang squatter, blottered na din since sya kasi yung nambubully saming mag ina.

So inaway nya kapatid ko, di naman nagkasagutan ng malala. Tas ang nangyari eh kahapon, pinatatawag sa barangay yung bully, hindi sumipot kesyo di daw pwede. Tas same afternoon kahapon, nagkasagutan nga sila ni mama. Tas yun nga daw may hearing daw nga dapat today ng 2pm. Tas ngayon, di na naman sumipot.

Question ko lang po mga sir / ma'am :

1. Yung pagpaparinig ba, constitute as bullying?

2. Since hindi sya nagpakita sa barangay twice, pwede ba namin ipatawag sa presinto na mismo yung bully?

3. Kung pwede yung sagot sa no. 2, pano po pag hindi din sya sumipot dun? Any more legal actions na pwede namin gawin?

Wala din sila karapatan dun sa area namin since squatter nga. Gusto lang namin ng nanay ko matigil yung pagpaparinig nila at pambubully since syempre, tao lang din kaming mag ina, masama din pag sinagad kami.

Sana may makatulong. Need lang talaga. Thanks.!

1. There is no such thing as a criminal offense of bullying, if you are referring to it as a crime. The most I can think of is unjust vexation.

2. No unless this person is caught in the act by a law enforcement agent, they do not go straight to jail. It does not work that way. You have to file a criminal complaint.

3. If the respondent refuses to appear despite notice, ask the barangay to issue a certificate to file action, whether for a civil or a criminal case.
