Hi.
Ask lang po ng legal advise.
Na term po kasi ako last 2015. I've been hospitalized and nag undergo ng surgery. Trainee po ako that time and pumasok ako nung time na namaga yung appendix ko. Pinapunta ako sa clinic ng trainer ko and dinala ako sa hospital. Na operahan ako same day. 2 days after my operation pumunta yung trainer ko sa hospital and nag provide ako ng certificate of confinement. A week after nakalabas ako ng hospital and nung 2nd day ko sa bahay I received a Return to work notice. So naisip ko hindi nafile yung medical leave ko. Nag submit ako ng actual medcert na may 1 month rest nung Nov. 2, 2015. And Nov. 9, 2015 I received a termination letter. Mag ka chat kami ng trainer ko simula pa nung nasa hospital ako and alam nya lahat ng mga ngyari sakin sa hospital at yung time na lumabas ako. The management decided to do cut and rehire process. And sinabihan ako na rehireable ako and pwede daw ako bumalik anytime. May 18, 2017 na ako nakabalik at nakapag apply ulit. Nag exam and nag initial interview ako sabi sa recruitment wait ko lang daw yung tawag nila for the result kung mag poproceed daw ako sa final interview kasi hhintayin pa yung confirmation from the management kung rehireable ako. 4 days later I received a call from the recruitment at ang sabi hindi daw ako rehireable at nag chat din ako sa fb page nila about my rehire status, same info lang nakuha ko. . Hindi daw ako rehireable. May laban ba ako at ma coconsider ba ito as illegal dismissal case sa NLRC kahit pa tumawag yung HR and they admitted na nagkaron ng problema sa system nila?

Nag file ako ng complaint sa NLRC dahil sa sobrang gulo ng systema at sobrang hindi makatao yung pagtrato nila sa mga agents nila. Nag mediation kami last week sa NLRC and hindi pumayag yung representative ng company na icompensate ako kasi pinapabalik naman na daw nila ako. Sinabihan pa ako nung representative ng company na gagastos lang daw ako sa attorney at matagal yung process kung itutuloy ko yung kaso ko sa kanila.

No, malabo na manalo ka.

Trainee ka nung pumasok nung 2015 and generally any absences while on training may warrant a dismissal for failure to complete training (medical condition notwithstanding).

Eventually it is management prerogative to hire who they want and to choose anyone who they want to work for them.

Paano mo nasabi na ayon sa kanila pinapabalik ka pero not eligible for rehire?

Move on na lang. Magastos yan para sa lahat, lalo na sa iyo.

Tumawag mismo yung hr head sakin and nag txt yung company before kami mag SENA. Hindi naman po siguro tama na iterminate nila ako kasi emergency at operation naman yung nangyari. Aware naman yung company na dinala ako sa hospital nung time na yun.

Nung nag apply ako last month sabi nung recruitment hindi ako rehireable. Tumawag ako sa HR and kinonfirm na hindi ako rehireable. A week before SENA I received a txt message from them and said that my profile is now active for final interview.

NO, you were a trainee, medical reason or otherwise, it was company prerogative to terminate your trainee status. Multiply yourself by the number of the trainees who will use that as an excuse to hold up the company from training other persons for the work that needs to be done. It's not fair to ask the company to wait until you get better and hire you.

I didn't ask the company to wait for me. Before ako mag clearance I was informed by hr na pwede ako bumalik anytime. And walang deadline na binigay sakin kung hanggang kailan ako pwede bumalik. Hindi ba ako ma poprotektahan ng " ternure security " kung sakaling ilaban ko to sa arbiter? I've been hospitalized, I gave them a document to serve as a proof na naconfine ako at nag undergo sa appendectomy, unfortunately hindi na file ng trainer ko yung medical leave ko, malinaw na negligence of duty yung nangyari.
