BP22/Estafa

Good afternoon po,
gusto ko lng tanong po kng ano pde namin gawin.
kc nghiram kmi ng 50,000, tpos ng issue kmi ng check,
and issued a check after a month.
kaso po nagipit kmi, instead ng byad kmi ng
25,000 pesos, then agreed too pay ng 10% interest dun sa ng papautang
then ung ng send cla sa amin ng demand letter
na within 5 days kailangan bayaran na namin ung later 25,000 + interest 2 months. naging 28,000 na. which is willing naman kme magbayad. pero ng hhingi lng kami ng ilang araw pa or maghuhulog lng muna kami ng 10,000 tpos next month ung rest na ng utang kasi wla kaming pera ngaun.
pde ba kmi kasuhan ng estafa or ung bp22 case?

they will have to deposit the check and then send you a written notice that it was dishonored before you can be liable for bp 22.

note that 10% interest monthly is unconscionable, but if you want to pay, that's by your consent.

i don't see any basis for estafa.

maraming salamat po sa pag sagot agad. ng usap po kanina. at try ko na mag offer ng mga properties ko na interested sila at nag bigay ako ng 3k para makabawas sa utang. pero ayaw daw nila at gusto nila buo ang ibayad kung hindi tutuloy na lang daw nila ang kaso? ang tanong ko lang po anu po ang pinaka worst na pwede mangyari? kc sa 27k hirap na kami tapos dadagdagan pa nila kung manalo sila sa kaso.

pati isa pa pong question, kc sa element 3 ng bp22, nakalagay po "the introduction in evidence of any unpaid and dishonored check, having the drawee’s refusal to pay stamped or written thereon, or attached thereto, with the reason therefor as aforesaid, shall be prima facie evidence"

yung na issueng check na 50k considered po ba na unpaid? kahit na nagbayad kami ng 25k+ interest 10%/month?

do you have proof of your payments? is there a written agreement that you will pay 10% interest?

did they actually file the case?
