Good day everyone. This is going to be a long post because I want to go into full details to provide you a clear picture of the scenario what my family is going through.

Here's the story.

Last December, my parents decided to buy a property, house particularly, from a relative (father's side). As already noted in the title, wala silang written agreement or contract, all verbally lang, dahil nga kamag-anak kaya sobra silang nagtiwala. So, everything's going fine naman. Nakapag-settle na kami ng 50k as downpayment. Btw, yung bahay pala, hindi yung relative namin yung first owner. Pabahay 'to ng NHA and the real owner sold it dun nga sa relative namin. Wala silang title ng bahay, instead Deed of Sale lang between sa first owner and relative namin. For 10 years, since nabili ng relative namin, never pa nabayaran sa NHA yung allocaty (not sure with the term, pero fee na binabayaran sa NHA monthly).

So when my mother went to NHA to settle sana yung mga unpaid na monthly dues, she learned the real status of the house, for closure na pala 'to. Kasi ang record ng NHA ay mag nagrerent and nakapangalan pa siya sa first owner. So NHA advised na huwag na namin ituloy yung pagbili ng bahay, kasi nga for closure na. Pinaupahan na raw, ibebenta pa, pinagkaakkitaan yung bahay for short.

So we opted not to continue with the agreement and asked our relative to return the money. To their surprise, our relative was also about to sell it to other person without our knowledge and magbabayaran na sila (yung dating renter lang din sana ang bibili) and you know what's worst? The day before na magbayaran sila ng bagong buyer, nagmessage pa siya samin asking for our balance.

Wala raw kaming karapatan kasi bahay niya yun. She believes na hinaharang namin yung buyer. I messaged her na ibalik niya yung pera. And as far is my knowledge is concern, wala naman akong masamang sinabi sa kanya kundi ibalik niya lang yung pera. I did not even harass nor force her. Siya daw dapat magbabayad sa NHA at namersonal pa, which I won't include here anymore.

Ano po kayang magandang gawin dito in case she continues to file a case against us and i-twist ang story since wala namang kasulatan? Thanks po. God bless.

Have a lawyer draft a demand letter for her to return the money.
