Namatay po ang nanay ko at may naiwan sya na loan... Kami pong magkapatid an sinisingil

Arresto Menor

Namatay po ang nanay ko last month, and may naiwan sya na loan. Pinuntahan po namin ung bank para magbigay ng notice at ng death certificate. Unfortunately, sabi po ng bank, kami daw po ang dapat magbayad ng loan na naiwan ng nanay ko.
Paano po ang dapat namin gawin?

check nyo yung terms ng loan ng nanay nyo kung may clause ba talaga na ganun.

Wala naman ganun na clause, at wala din naman kami pinipirmahan. Tska as far as I know kasi dapat estate na ni nanay magbayad ng loan. E wala din naman estate na naiwan nanay ko.

if wala silang maipapakita na katibayan na dapat kayo ang magbayad eh wala silang habol sa inyo. regarding sa walang estate ang nanay nyo, do you mean wala kayong bahay na nakapangalan sa magulang nyo?

I asked kung ano yung basis ng paniningil nila samin, pero nagalit sakin yung bank manager, masyado daw ako masungit, at di daw nila alam ung estate na sinasabi ko. Bobo daw kasi sila. I really don't know bakit naninidak yung bank manager.
Yes something like that. Yung bahay kasi ay sa lolo ko sa father side.

This is incorrect. The left properties of the deceased will answer for the debts, and taxes to the government, before anything is to be shared by the heirs.

IF the heirs divide the properties of the deceased before paying the debts and taxes, they will have to pay to the extent of what they receive.
