when is training contract not binding?

i entered into a training contract because a friend offered me to attend a training regarding sonography. dahil kakilala ko naman sya pumayag ako. after ng training naging on call ako na sonographer sa kanya. ang sweldo ko per patient is 400 plus additional 100 pesos sa susunod na patient. wala akong benefits. walang SSS, philhealth..etc..hanggang last february of 2017 wala akong trabaho ng isang buwan. kung hindi pa kami nagkabanggaan sa isang mall hindi ko pa malalaman na wala pala akong trabaho dahil pina rent na niya sa hospital ang echo machine niya. after a year dun ako nagdecide na mag apply na sa iba kahit na ang nakalagay sa training contract ay dapat 4 years ako magtrabaho sa kanya. eventually naka work ako, without letting them know kung ano ang nature ng trabaho ko. sinisingil na ko at sinabi ko hindi ko kayang bayaran ng buo ang 50k.nalaman din nila kahapo kung saan ako nagtatrabaho at kanina hinatid sa akin yung training contract na ngayon lang din nila pinanotarized. ang tanong ko employed ba ako offiacially dahil sa training contract na pinirmahan ko? ano dapat ko gawin? thanks and God bless sa advise.

it's a training bond contract. ito yung mga nakalagay sa contract.
1.the owner enlist the trainee in a training program in the field of echo cardiography and the former shall shoulder the training expense estimatedly at 50,000php.
2. the period of the bond is four years from the completion of the training.
3. the trainee shall pay the entire amount of the training costs if she terminates her employment before the expiration of the four years bonding period:and
4. payment of the training cost shall be waived if owner terminates the employment on the following grounds:a) poor performance rating;and b)as a result of disciplinary action against the trainee

i'm working now in a hospital as a cardiac technician NOT a cardiac sonographer.

Meron bang available na trabaho para sa iyo dun sa kumpanya?

Kung wala na, dahil wala na ang machine, your contract could also cease.

kung hindi ka nya kayang bigyan nang trabaho, eh tapos na yung contract nyo..

for the whole month of february 2017 yung machine pina rent nila sa hospital,wala din akong income for the said month. sabi sakin if mag ok daw yung deal niya sa san juan, ako daw gagawa ng echo dun. kaso i decided na maghanap na ng ibang work kasi kung hihintayin ko pa yun paano na yung family ko, i have 2 sons. ngayon sabi nila they are consulting their lawyer on what legal actions to make. what if they demand that i should pay the 50k in full, which is hindi ko kayang ibigay ng buo?

the court will decide kung how much of that 50k ang kelangan mong bayaran and kung pano.

during the training ako ang gumastos ng transpo allowance ko. pwede ba yun ibawas sa 50 k? is the training bond contract also serves as my employment contract? hindi din nila ako pinagawaan ng ID.

on call sonographer yung trabaho ko. wala akong payslip. for the entire one year na nandun ako sa kanila wala pang 20 patients ang na handle ko. tama lang ba yung naging decision ko na maghanap na ng trabaho na regular at may benefits?

nope, hindi pwedeng ibawas ang transpo. and no hindi sya magiging employment contract. Hindi required na merong wirtten na employment contract.
tama yung decision mo pero dahil pumirma ka ng training bond may posibilidad na ipabayad sayo yung 50k plus attorneys fees.
advice konlang as much as possible wag pumasok sa kasunduan na may bond or length of stay. kung yan ang requirement either maghanda na tatapusin or maghanap nalang ng ibang job opportunity.
