Company "V" started po dito sa pinas last 2007 pa. I was lucky to be of service sa kanila last 2011 as a contractual employee. Then my contract ended last quarter ng 2011 din po. As per advice ng lead ko sa Company, they are in need of engineers by next year (2012). Then i waited by first quarter of 2012 i was hired as a regular employee.
Company "V" po pala e isang epc (engineering procurement and construction company) na may mother company sa Pasadena Texas.
As years go by na naging mahina ang oil and gas. Mother Company and Company "V" e nagbawas ng tao... sa US e alam ko po madali magtanggal since iba ang law nila.. dito sa Pinas last May 2016, was ang first batch ng redundancy, lahat ng nasama e nakakuha naman po ng severance pay and was given 30days para maging officially not connected with Company "V". Then by Dec 2016 nagkaroon po ng 2nd batch ng redundancy, ganun din po ang nangyari.. they were given severance pay and 30days.
And i thought i was lucky at di ako nakasama sa 2 batches of redundancy
After holyweek this April 2017.. nung April 21, 2017 e parang pangalawang biyernes santo ko. THe company told us by email na company "V" was for closure.. we even had a conference call sa CFO ng mother company at ang sabi nga e wala kami makukuha na severance pay.. ang tanging maibibigay lang e ang last pay, prorata 13th month pay, at SL/VL conversion.
With my 5 years with the company, at as per policy din nila e entitled naman po ako sa severance pay diba po?
considering iba sa opismates ko e mga pioneer pa.. since nagstart si company "V" e nandun pa sila..
DO i need to file a suit against company "V" sa NLRC?
kasi same day closure ang ginawa nila.. sa US at dito sa pinas.. diba po iba magkaiba ang law natin sa labor/employment?
E papaano po kung mag file nga, e kung sabi ni CFO wala talaga funds e di kahit manalo sa case e wala pa rin ako makukuha na severance pay?
PLEASE ADVISE ASAP at ang balita ko by MAY1 e close na daw ang US OFFICE.. if ever i file a case.. sino pa kayang hahabulin? can we get yung bond ni company "V" sa SEC ?
