Hi! I just had a vehicular accident last year Octovber 2010) with a Public Utility Bus that damaged my left side mirror. I have filed claims from their insurance agency since their unit is insured. However, the approved amount will barely cover for the estimated amount from the casa. My car is brand new (2010 model) which only justifies why i wanted a replacement for the part instead of mere restoration. Since Ive been talking with the bus company and their insurance agency for over 3 months now for a very small amount of money, Ive decided to cancel the Cert of no claim which i secured before from my insurance agency and have filed claims from them. However, there is a certain amount which has to be paid. Since i wouldnt be filing any more claims from the bus company's insurance, I told them to cover for the participation fee instead. To my dismay, they still wouldnt want to cover it.

The police report clearly states that it was the bus that intervened with my right of way and intentionally sped off while passing thru the lane on my right which resulted to the damage of my side mirror. I'd like to know if there are legal actions that i can take re this case. this incident has already been giving me too much hassle. Thank you for akll the help.

it is my position that they can validly refuse to pay your participation fee because it will not release them from liability. in fact, it will be your insurance company that can do it because you are subrogating it to them.

that is the purpose of insurance: for the cost of the premium and the participation, you get to have your car fixed without having to go through legal proceedings and claiming.
