Hi,

I would just like to know your advise on below scenario:

Na hire ako Aug 21 2016. My performance was evaluated on my 5th month, to be specific that was like January 20, 2017. (Aminado naman ako na hindi ganun kaganda yung performance ko haha, kaya nga pa resign narin talaga ko nun, anyway) Going back, below are the exact few words that my supervisor told me:

"Meron ka pang 1 month bago ang iyong regularization, so dun sa 1month na yun dun ka namen i-eevaluate para sa regularization mo. We can see kasi that your performance has ups and downs. There are times you're okay then biglang hindi."

So everything were okay, wholeheartedly tanggap ko naman yung comment ng supervisor ko saken. I know naman kasi myself. Hehe. Guilty is me haha

And then, the following month. On February 15, 2017 biglang.... tinawag ako para kausapin. My supervisor told me...

"Upon agreement with the management, ite-terminate na namen ang contract mo kasi hindi mo na-meet yung qualifications" So ako naman "Ahh okay po" then I asked, So ibig sabihin po ba nian tatapusin ko nalang yung ika-6month ko then exit na ko sa company?? But sabi saken, "No, pwede ka ng hindi na magreport bukas". Hahaha. At first oo lang ako ng oo, pero ngayon para naisip ko parang may mali.

Wala naman talaga mali kung iterminate nila ko for certain things or company qualifications na hindi ko na-meet.

But the thing kasi is sobrang biglaan. Nagbasa basa ako/nagreseacrh. Parang sa ibang bansa ata okay lang yung ganun na treatmnent, yung "surprise termination" Laughing

Naisip ko lang na hindi ba dapat kahit papano bigyan nila ng sapat na panahon para maka pag handa ang isang empleyado para din mai-ready ang sarili nia sa pagkawala ng trabaho o kabuhayan nia??

Maraming salamat po sa makakasagot.

Gusto ko lang din maliwanagan at kung may kaparehas din akong sitwasyon baka makatulong din.

Pasensya na kayo ang haba ng kwento ko hehehe

Opinyon niyo po kung tama ba yung ganung proseso bigla nalang iterminate ang isang empleyado ng wala man lang palugit?

Sasagutin ko ng deretcho ang tanong. Meron Supreme Court case na pagkatapos ng huling araw ng Probationary period ng empleyado bago ma-regular, siya ay hindi na pinapasok ng guard sa gate.

Sabi ng korte, ito ay legal dahil itong aksyon ng employer na ito ay katumbas ng pagsasabing 'hindi na mare-regular' si empleyado'. Dito ay walang actual na dokumento na nagsasabing hindi mare-regular si empleyado.

Ngayon, i-compare natin sa sitwasyon mo. Nangyari ito ilang araw bago matapos ka dapat ma-regular. So, comparison, kahit mismo sa last day mo mismo sabihin sayong 'hindi ka mare-regular', ito ay legal.

Gaano katagal na panahon para makapaghanda?

Pag sinabihan ka by Feb 1 kunwari, na terminated ka na -- at effective Mar 1... pag hindi maganda ang pagsasama ng mga tao, pwedeng gumawa ng milagro ang empleyado at baka merong hindi magandang mangyari sa kumpanya.

Now, it make sense.

I was just really affected by what happened, honestly. Though I am determined to file for resignation by end of February that time, however its a totally different thing/feeling when it is the company who initiated to let go of you, and not because you solely decided to leave. Crying or Very sad (ganun pala pakiramdam, first time ko kasi materminate)

But atleast I know now that what they did was just fair enough.

They released my final pay on the same day.

I guess sometimes, i'ts company's prerogative if they intend to be more gentle with their employees in terms of terminating their employment.

BTW, they're not paying overtime & night differential, haha loko lokong kompanya yun! Laughing Payroll processing talaga at Gen Acctg ang linya ng trabaho ko kaya alam kong may mali sa proseso nila, hindi kasi ganun ang sabi nung una. At isa pa, hospitality industry sila, hindi talaga ko bagay dun. Ewan ba bakit pumirma ko ng kontrata sa kanila, lesson learned! Laughing Anyway, may bago naman na ko trabaho ngayon hehe. Thank you sa pag terminate nila, dahil mas mataas na rate ko ngayon, madami pa benefits. Laughing
