I filed illegal dismissal case against my previous company but was put to suspension because the company is under rehab status. What else can i do claim damages from them?

Who gave the 'suspension' order? Was there already an order that you are entitled to a monetary award?

The fiscal who handled my case in NLRC gave the suspension order. No there was no order to pay me monetary award. Yung nangaling sa nlrc is suspension of proceedings bec the company is under rehab. However the said company is under rehab since 2000 and until now they are using said status whenever there is a labor case filed against them.

Please get your facts straight. Fiscals CANNOT represent any party in a labor case. Maybe you are referring to an Arbiter or someone.

If the NLRC issues that order, you have no other option but to wait.

Sorry. Yes its the arbiter. Thank you. You mean i have to wait hangang sa ma lift ang under rehab status? Pero paano po ba malalaman kung na lift na po ang status na yan ng previous company ko? Thanks po ulit.

Hi sir! Nais ko po sana hingin ang inyong tulong para sa aking kaibigan.
Naniniwala po kami sya ay nadismissed illegaly noong Feb 14 ngayong taon, 8 araw bago sya maregularize. First hearing nya sa NLRC ay noong March 31. Noong tinanong ng arbiter ano ang gusto ng kaibigan ko ang sabi nya reinstatement and she wants whatever is due to her plus monetary claims on moral damages. Ang sabi po ni arbiter bakit daw humihingi na sya ng moral damages claims hindi pa naman kasuhan. Ang reply ng kaibigan ko, because she believes she deserve it. Nareduce po yung claims ng kaibigan ko sa whatever is due to her. Kasi po sabi ni arbiter walang moral damages at sabi ni laywer na representative ng employer ay no-no na daw sa reinstatement. Icoconsult daw po ng lawyer na ito sa employer kung ano ang halaga na pwede nila ibigay. Pagkatapos pinapirma na po yung kaibigan ko, sa tingin ko minutes po iyon nung naganap na pag-uusap.

Ang nais ko po sana idulog sa inyo ay ganito: entitled na po ang kaibigan ko na ito ng backpay na makukuha nya after 3 months na pagkatanggal sa kanya. Paano po kung ganun lang din ang halaga na sabihin ng lawyer sa second hearing na ibibigay ng employer sa kaibigan ko tapos sabihin nila na yun lang kasi ang hinihingi nya at yun ang pagkakaunawa nila sa sinabi nya na "whatever is due to me"? Kasi po diba kung yun lang din ang ibibigay ni employer, parang nawalang saysay po yung pagdulog namin sa DOLE habang nandun pa din yung katotohanan na nadismiss sya illegaly.

Sa akin pong palagay my friend deserves better than that lalo na po at isang buwan syang nawalan ng trabaho at sweldo, isang buwan bago sya nakahanap ng bagong trabaho. Alam naman po natin na di madali ang maghanap at mag-apply. Pwede po ba nya sabihin sa second hearing na backpay plus monetary claims during unemployment ang gusto nya?

Salamat po sa inyong magiging sagot. Makakatulong po ito ng malaki kasi po pinanghihinaan na ng loob ang kaibigan ko at nastress na sya kasi pakiramdam nya wala syang kalaban laban. Maraming salamat po ulit. Ngayong darating ng Friday na po yung second hearing.
