Mother Refuses to Pay for Son's Tuition Fees

Greetings!

I want to know what possible courses of action I can take given the following circumstances:

a) My mother is a high school teacher in a public school. My father informed me that she had already attained a Teacher III status, and according to research, she is most likely earning more that Php 25,000.00 per month. On the other hand, my father who is also a government employee is earning only Php 15,818.00 per month.

b) My mother refuses to pay for my brother's college education, which according to research amounts to Php 37,051.80. My mother had stopped paying for my brother's tuition fees since my brother's fourth year in high school. Because she refuses to pay for my brother's tuition, my father did his best to pay for the tuition expenses himself, resulting in the application of numerous loans currently leaving him with a net pay of more or less Php 4,000.00 per month.

c) My father was recently involved in a vehicular accident where he was forced to loan money to pay for hospitalization expenses. A settlement had been reached, but now my father can no longer fund for my brother's tuition fees.

My question: Is there any way by which we can demand that mother pay for my brother's tuition fees?

For under age kids it's a demand the parents support.

I suppouse your mother didn't pay child support for living costs too. Corect?
I don't know how long time back such can be demanded, and I don't know if Barangay Captain handle such cases. Ask there.
Otherwice you can make a demand letter to your mother and if she don't pay, you can try to make "Small claims court" agree to it.
(Perhaps PAO can assist some., =Public Attorney Office.)

Concerning young but grown up kids, the law is some fuzzy. I INTERPREETE it as support CAN'T be demanded for college fees.

There is an other option, which make many poor Filipinos manage to get college education. I have forgot the expression but the education is COMBINED with working so the student can finance his education HIMSELF.

Concerning your father's depts, this can perhaps assist recovering by geting lower interest:
I suppouse he is in SSS, Philhealth and Pag-Ibig. I know SSS can lend out some money (I believe max 15k) and if I remember corect one of the others can lend out money too. (I mean to OTHER than housing.)
(Or if you have a property without max loan, that can be worth checking because such loans have lowest interest.)
