Hi,

Good day!

I need a help on my ongoing issue.

Can I be charged of kidnapping by the mother of my son?

We are not legally married from the time that we had a son until today because her marriage from her ex-husband has not been annulled nor nullified. When we had a son in 2015, she had her maiden name written on the birth certificate . I signed the birth certificate as the legal father of my son.

We are now decided to be separated and I have a plan to take my son with me, but she told me that she will charged me with kidnapping if I do that.

Please enlighten me.

yes she can since you only have visitation rights to your child if your not married to the mother.
