Dear Atty,

The wife abandoned her husband due to infidelity. Despite the husband asking for forgiveness and being given a second chance, the wife treated him as if he did not exist, eventually moving out of the conjugal home. The wife is now working as a public school teacher while the husband, as a result of this incident, quit his job and no longer works. He earns his maintenance by investing the funds he received for early retirement although income is not assured by the very nature of his new undertaking. The wife also had entered into a romantic relationship with a fellow public school teacher.

After less than a year of living separately from the husband, she visits the conjugal home, barges in, and demands one half of what the husband received, claiming that she is entitled to it. She even set a deadline of 1 month. She said that the house she is renting is being sold and she wants to buy it at a cost of about 2 million. The conjugal home, which the husband is still paying mortgage on to Pag-Ibig is worth only half that amount. In addition, the husband continues to pay for the college education of the youngest son. The husband is also dealing with medical issues that make living alone more difficult.

Is the wife correct in setting her own terms on what is due her? What are the options of the husband?

don't comply with the wife's demand. let them go to court. Just make sure the husband has enough proof of the infidelity as he can use this to have the court side with him. regarding the conjugal properties that they have, they each own 50%.
