HELP PO. SINU PO HAHABULIN?

pls help me.. i have no idea what to do.
im just a simple man na nagtiwala and naloko.

here is my case:

-may contract po kami sa isang company na 40% interest babalik sa capital (50K php)namin monthly.

-naka sali kami since oct 22, 2010

-total of 102k na po this jan ung interest + capital

- since nung sumali kami wala pa pong binigay ung company

- sa contract may middle man (friend namin)so nandun nakapirma ung company owner, ako, and ung mid man as witness/consultant

- we ask the mid man na kunin na ung pera.

- claim ng mid man na since november di sya sinusweldohan ng owner and puro promise lng na magbibigay ang owner

-i tried to contact the owner directly tru txt and calls, but ganun din puro promise.

- i tried to talk to him personally pero di sya sumisipot sa usapan

- i tried to ask the mid man kung sya ba sasagot ng pera, sabi hindi naman sya may ari ng company

-nag usap kami ng mid man to provide us the owner kasi di pa namin na kita or na kilala un. wala naman sa address ng office nya ung owner

here are the point to remember:
*contract lng ung hawak namin (ung copy namin)
*ung contract ay hindi naka notaryo
*ung copy ng dapat sa owner ay nasa mid man
*nung pimahan, ay may pirma na ung ower, so mid man and ako ung nag meet
*never pa namin nakilala or nakita ung owner
*binigay namin ung 50K hand- hand sa mid man
*walang receipt na naibigay ung mid man samin or any proof except ung contract.
*wala din mapakitang proof na binigay ng mid man sa owner ung 50k. (bank receipt or "receive by")

does your contract state that you gave the 50k?

opo. meron po. sa contract, it states that i gave 50K php and that 50 k php ay pwede makuha any time.

pls give me some advise. kasi ung mid man ung kinakausap ko na iharap samin ung owner. then if di nya mahagilap. sya ung hahabulin namin sa pera. (nag consider din po kasi akong fictitious char ung owner). tama po ba mga ginagawa ko? anu po next ko na gagawin? pls advise me thank you.

the contract is between you and the company?

estafa would be the best case to file against both the person and the company. send first a demand letter to the mid man and to the address of the company. good luck.

opo, the contract is between me and the company.
so both po ung hahabulin namin? (the owner and the middle man?)

thank you po. and nakalimutan ko po sabihin. walang any kind of receipt or "received by" na binigay sa amin.

i believe your question has been answered. if it states in your contract they received the money then that is the proof.
