Hi,
I have a lot in a subdivision and I want to build 3 units of apartments.
Questions:
1. I bought the land from a private owner and not the developer, do I still need the developers clearance to construct my apartments?
2. Can I have the lot subdivided into 3 titles?
3. Can I sell the apartment units separately?

Hello,

1. Has the subdivision been turned over to the Homeowners' Association? If not, you still need clearance from the Developer. There usually are Deed Restrictions which bind the homeowners to these rules, which usually take effect for 25 years. If it's been turned over, there must be clearance from the Homeowners' Assoc.

3. Yes, if the lot was partitioned already.
