Hi Atty. I'm working in a BPO industry. Mag-3 months na ko sa company. Absent ako for 2 days dahil nagkasakit ako. Nakalagay sa pinirmahan ko upon joining the company, leaves can only be use upon completion of training. Tapos na po ang training ko dahil 1 month lang nag run yun and now nagcacall na ko and part na ng production floor which means tapos na yung process training. Then all of a sudden I heard na after 6 months pa daw pwede magamit ang leaves and even sick leaves. Wala namang nakalagay sa pinirmahan ko na kontrata na upon regularization pa lang pwede gamitin ang leaves.

I'm part of Wave 4, yung Wave 2 and Wave 3 eh ahead lang samin ng 2 months which means wala pa silang 6 months pero last december nakakuha na sila ng leaves encashment kahit kaming wave 4 eh wala pa dahil ang reason nila eh nesting pa lang kami. Confusing po kasi sabi nila dati magagamit namin yung sick leave kapag graduate ng nesting. Nakagraduate na po ako ng nesting and part na ng production floor. Hindi ko lang po maintindihan sa kanila kung bakit paiba-iba sila ng sinasabi kahit na nakalagay naman sa kontrata na upon completion of training namin pwede magamit ang leaves.

ano ang question mo? may copy ka ng contract? could you state exactly what it says?
if di mo magamit yung leaves makukuha mo naman sya in cash so same din. furthermore leaves need to be approved.

It states there "Leaves can only be used upon completion of process training."

I understand na yung vacation leave needs approval but sick leaves is a different story. Ang question ko po eh anu ba dapat ko gawin kung di nila ipapasok as sick leave yung 2days absence ko? Kasi we were told na yung sick leave pwede na magamit kapag naendorse na kami sa production floor which we we did. And it's states in the contract din naman.

Sayang pa din po kasi yung 2days ko na nagkasakit ako if di maipapasok as sick leave. Yung encashment naman sa december pa yun. Kung ganun lang din naman pala sila kalabo kausapa edi sana pumasok na lang po ako kahit na maysakit ako.

Hindi pwedeng baguhin yung nakalagay sa contract. If ever may ganun man, it should be properly communicated with the employee, and both parties should agree. Ilan bang leave credits magagain nyo per month? You should ask your HR if may policy sila na need mong magpresent ng med cert. Bago iapprove ng supervisor mo yung SL mo.

1."Leaves can only be used upon completion of process training" - this means hindi pa pwedeng gamitin pag hindi pa tapos ang training. This does not mean pag tapos na ang training pwede nang gamitin. There may be other conditions to be fullfilled. It should've read "Leaves can be used upon completion of training" Pls. notice the difference.

2. Unless stated otherwise sick leaves are subject to approval as well. You have to understand sa batas walang madatory na sick leave. Kaya ang sick leave ay bigay lamang ng companya kaya sila ang nagtatakda kung pano i-avail ito.
