Hi, I would just like to get advice. Does the Registry of Deeds (ROD) have the right to extinguish voluntary easement given by the servient estate upon the sale of the property to a new owner? My new neighbor has fenced our road without our consent. While the old title shows a memorandum of encumbrance, he showed us a new title (upon buying the property) without the encumbrance. The new neighbor told us that sale of the property can erase previous voluntary easement according to the ROD. Please help. Thanks.
