Nakatira ngaun sa parte ng lupa na tinitirhan namin ang uncle ko na nagsangla. Ano ang dapat naming gawin para hindi mawala ang lahat ng hirap ng papa. Walang naitulong ang ibang mga kapatid ng mama ko. Pede ba naming kasuhan ang bank or ang uncle ko?

(My Tagalog is bad, so I'm not sure if I understood.)
As I understand it, the bank has FORECLOSED the property because of unpaid loan with the property as collateral.

"2010. And the bank is still paying the tax"
It seem the bank has very hard to sell it. It's a max time limit banks are allowed to keep foreclosed property. I BELIEVE it's max 5 years. So they can be in panic to sell Smile

Two perhaps possibilities:
1. Ask the bank what they can sell it for. Because of the max time rule, and problem for them to sell, the price can be much negotiable Smile
2. Within a year from the Foreclosed property is SOLD by the bank, the earlier OWNER have right to buy it back for a price a control organisation decide. (HLURB ?)

Problem for p2 - you are not the earlier owner, so if you try that, you need to solve that forst, which is complicated.
But p1 is "easy" solved juridicaly because it can be done by ANYONE by just paying (but then you can be forced to sell it to the earlier owner within a year, but I suppouse that's no problem.)

I didn't understand if the property was used as collateral illegaly by the borrower owned only a bit of it, but I suppouse the bank aren't prepared to let it go for less because of that, so it would be a very hard process to winn such case. So such compensation you would need to try to get from the borrower, which I suppouse would fail, because he don't have assets, and you would only get part of the compensation anyway, because of there are more hiers than you.

boss gud pm.... meron po ako deed of transfer of rights ng haus ko ( ung haus ko po binili ko lang sa frend ko na binabayaran pa sa PAGIBIG). tapos utang ako sa company nmin pampagawa ng haus ngayon hinahanapan ako ng DEED OF SALE ng haus. eh wala po ako nun pinalitan ng PAO sa manila city hall ginawa nyang DEED OF TRANSFER OF RIGHTS AND ASSUMPTION OF MORTGAGES.
