Ako po ay isa sa empleyado ng network na ito, at sa department po namin inaabuso na po kami, regular employee po Ako sa company and as per contract ko po, I signed as an official audioman for the company, our department forces us to drive company vehicles on our everyday work, pag po na aksidente kami, suspension po agad, and we are forced to work overtimes.. Madalas po 12hrs minimum working hours..depende po kasi field work kami, pag po umuwi kami after we rendered our 8hrs duty..kinakasuhan po kami ng abandoning or insubordination, tapos po pag nag work po kami ng 30hrs without sleep, binabawasan po nila Un overtime na dapat po nilang bayaran, pag nagreklamo po kami, on hold po ung sweldo namin until po mag give up kami sa right claims namin sa overtime, and ung job order po namin gumawa po ulit ang department namin ng new job order inserting all new loads sa trabaho without compensation, gnagawa po kaming on call kahit po wala sa kontrata, pwersahan po nila kaming pinapapasok pag rest day or holiday po, pag hindi po kami pumasok, pinapagawa po kami ng explanation report, pag hindi po valid, we are subjected to suspension for neglect of duty. Sana po may makatulong.. Thnx

Pwede ka naman mag-resign kung ayaw mo na o hindi mo na kaya ang kanilang ginagawa sa iyo.

Pwede ka rin naman magreklamo sa DOLE.

If magrereklamo po kami sa Dole may chance po ba Un case namin? Kasi po baka po irefer muna kami sa union namin which is ung union namin is Naka kaso po sa supreme Court dahil po may anumalya sila sa mga members po nila..

Isa isahin natin ha, para lang malinawagan ka kung alin ang complaint na may merit.

1. our department forces us to drive company vehicles on our everyday work, pag po na aksidente kami, suspension po agad - this is legal as long as the suspension is deemed preventive not punitive.
2. we are forced to work overtimes.. Madalas po 12hrs minimum working hours..depende po kasi field work kami - also legal
3. pag po umuwi kami after we rendered our 8hrs duty..kinakasuhan po kami ng abandoning or insubordination - also legal thats why they can file insubordination or abondonment/neglect of duty against you
4. tapos po pag nag work po kami ng 30hrs without sleep - If you have the exact dates, and this happens regularly, baka pwede ireklamo under unsafe working conditions.
5. binabawasan po nila Un overtime na dapat po nilang bayaran - find out if you are considered a field personnel, na mention mo kasi kanina na sa field ka. Field personnel are not entitled to overtime.
6. on hold po ung sweldo namin until po mag give up kami sa right claims namin sa overtime - again if you are considered field personnel you dont have claims for overtime.
7. and ung job order po namin gumawa po ulit ang department namin ng new job order inserting all new loads sa trabaho without compensation - hindi talaga kelangan ng compensation unless they are requiring you to work additional hours.
8. gnagawa po kaming on call kahit po wala sa kontrata - if on call but not requiring you to stay sa vicinity ng work place. This is legal. If they are requiring you to be near the workplace while on call they should pay you.
9. pwersahan po nila kaming pinapapasok pag rest day or holiday po, pag hindi po kami pumasok, pinapagawa po kami ng explanation report, pag hindi po valid, we are subjected to suspension for neglect of duty - this is legal.

As you can see #4 lang ang medyo tama yung reklamo. And this depends alot kung gano kadalas mangyari and how you can prove 30 hours straight work if you are in the field.
The other complaints would depend if you are a field personnel or not. Some of your complaints are not valid

1. I read a company policy po dito sa company namin stating, only company drivers should operate company vehicles, and our department was divided into to divisions, sa division lang po namin ung wlang drivers, nung nagtanong kmi sa hr, they told us that hands off na daw sila dun kasi jurisdiction na ng department namin.
2.regarding overtimes po, nasa company policy din po namin na pwd lang po kami pilitin mag overtime incase of war of ikakalugi ng company, actually gnawan na to ng paraan nuon kasi shifting po kami sa field, and 24hours po ang operations, dahil po dumami ang facilities, nagbawas po ng tao so they need to extend working hours
3. Pwede po ba sila mag file ng abandonment if we already rendered regular 8hrs of our duty?
4.we do have a company policy po na if you have less than 8hrs sleep sa operations.we can file the succeeding hours to straight filing which is x3 sa regular fair, so what our department did was cut the time rendered and formulated a term "gentle man's agreement"
5. What do you mean po na as field personell hindi po kami entitled sa overtime?
6.oh ranking file po kasi kami and we are paid per hour, so we are entitled overtime po, ayun..
7.is it OK po ba na ireconstruct ang job order po namin by our department without any signatories? Nung pinuna ko po Un..they suddenly recalled all of our distributed job orders, I got a copy.. Hndi ko po isinauli,
8. We are on call, like for example po, 10pm ng gabi nag out po ako, then suddenly somethings up, so at 1am they needed me na pumasok, or any time of the day, and I have a regular duty that is 8am-4pm
9. Regarding po sa load na additional sa duties namin.. Before may mga tao po sa equipment or fpor the position, then these people are asking for compensation kasi po mejo complicated ung trabaho nila, so ang gnwa nila.. Inilipat nila ung tao which is lateral transfer, then kming mga naiwan ang sumalo, Nung una sabi po pag aralan lang habang nag aantay ng kapalit.. Pero Nung nag tagal, they are starting to sanction us kahit po hnd kmi designated for the said job.

1. Yes but company policy yan eh. Pwede mo isumbong yung superior mo sa HR or someon higher than him. company but hindi mo pwedeng isumbong yung company sa DOLE sa hindi pag follow ng company policy.
2. Again company policy yan. If you want to complain to DOLE kelangan against labor law ang basehan. (unless these provisions you are citing is in your contract)
3 Hindi pwedeng abandonment. Technically kasi abandonment ay iniwan mo na ang trabaho at wala ka nang planong bumalik. More of neglect of duty or insubordination ang ikakaso sayo. Yes kahit 8 hours na ang duty if kelangan ka nilang mag overtime you have to comply
4. Hindi ko maintindihan yung sinulat mo.
5. Merong isang classification ng employee na termed field personnel. Hindi sila entitled to overtime pay.
6. Rank and file ang field personnel. Make sure hindi kayo classified under this category
7. Its an internal matter. Hindi ito pwedeng maging reason for complaint.
8 Yes this is legal.
9. If they are issuing sanctions, let them know na hindi ka qualified to do the job (make sure na hindi ito under your job description). If ni suspend ka or tinnangal bec hindi mo magawa properly yung job na hindi ka naman ni hire for you can file a complaint. But cannot file a complaint dahil hindi ka binayaran ng extra.

1. Nung lumapit po ako sa hr legal namin.. I talked to the legal department head, he told me off hands na daw sila sa decision ng division head namin, I said we are still an employee of our company, then sabi sakin better talk to your union president then kami maguusap para magawan natin ng paraan..and knowing our union is a company pet.
2. Sana po pansinin kami ng Dole, mejo untouchable po itong company nmin
3.we are entitled naman po with overtime payment, the problem po ng management is over budget po ung allotted sa division namin dahil sa overtime palang,.so ang solution nila is to cut rendered hours,
