Good day!

Hingi po sana ako ng legal advice. Nung Nov.17,2016 nagpatawag po ng meeting yung company namin,alam po namin parang ordinary meeting lang po yon at nabigla po kami binigyan kami ng NTE letter.Nakalagay po dun na naka preventive suspension po kami for 30 days. At meron lang kaming 48hrs.para makapag explain tru letter. Lima po kaming sinuspendi nila,nag start po yung suspension namin nung pina received na nila yung sulat. Nov.28 nagkaron po kami ng hearing after po nun sabi nila maghintay lang po kmi ng email nila. Dec.14 po pinatawag ulit kami at laking gulat po namin pinapag sign na kami for dismissal plus resignation letter na sila na po gumawa.

Trabaho po namin is mag approve ng complimentary rooms and foods/drinks ng mga guest namin.Wala naman po binigay yung company namin ng rules bout sa pag approve ng kwarto at pagkain. Kumbaga self jugdement po ginagawa namin if qualified maka avail ang isang guest po namin.

Di po kami nagsign dun sa letter for dismissal na pinapa sign nila.ginawa po nila pina lbc nila para matanggap namin. Nakalagay pa po dun sa huling paragraph ng letter is terminate na daw po kami once na nareceived po namin yun. Tama po ba yon? Tama rin po ba yung agad agad kaming dinismis ng di man lang po kami dumaan sa due process? Di man lang po kami na verbal or written warning kung may mali man po sa ginawa namin,kaagad na pong dismissal.

Problema din po kasi sa manager namin di man lang po kami kinausap na may issue na plang ganon. Kaagad nya pong pinabot sa HR.

Last question po, tama po bang hindi magbigay ng copy of contract yung isang company? Kasi  kami po di kami binigyan ng copy.

Sana po mabigyan nyo po ako ng advice.

Nakalagay pa po dun sa huling paragraph ng letter is terminate na daw po kami once na nareceived po namin yun. Tama po ba yon? - Na terminated na once natanggap nyo? Yang letter na pinapareceive sainyo at ni send thru lbc ang notice of termination. Yes tama yanonce na receive nyo na ibig sabihin alam myo na terminated na kayo.

Tama rin po ba yung agad agad kaming dinismis ng di man lang po kami dumaan sa due process? - meron nang due process, di pinasulat kayo ng letter to explain?

Di man lang po kami na verbal or written warning kung may mali man po sa ginawa namin,kaagad na pong dismissal. - depende sa gravity ng offense, sometimes warnings are not necessary.

Last question po, tama po bang hindi magbigay ng copy of contract yung isang company? Kasi kami po di kami binigyan ng copy. - no provision in labor law that requires employers to give their employees a copy of the employment contract.

If you feel na too harsh ang naging decision ng employer nyo, pwede mong idulog sa nlrc, but from my observation based on the limited facts that you have mentioned, they have followed procedure and terminated you properly
