Good morning Sir/Ma'am, I was thinking on what case I could file to my ex-boyfriend for telling me and making me believe he isn't married and accidentally I'm now pregnant. So many what if's are running into my mind. I really didn't know he's married, when my mom asked him before if he was married, he said he wasn't. Until recently, her wife called me. Ofcourse, I didn't admit it though I have a plan telling her soon if I find a case to file against his husband, my ex-boyfriend. He ruined my life, I want to sue him. Is there any case that I could file for me to sue him? Thanks.

How old are you? If you are still a minor, you could file corruption of minor.

You could also file charges for child support once he/she is born , but you have to prove that the child is his.

Since the deed was done before you turned 18, the case will more likely be corruption of minor, and its more likely he cannot win this case given the evidence you possess.

What if he tries to file concubinage on me? I didn't even he was married.

Well yes, the wife can charge concubinage against the both of you, but you have to remember that you were still a minor (so the law will, hopefully, be lenient on you) and concubinage is hard to prove.

Concubinage also has its elements

1. The man must be married;
2. That he committed any of the following acts:
   a. Keeping a mistress in the conjugal dwelling
   b. Having sexual intercourse under scandalous circumstances with a woman who is not his wife
   c. Cohabiting with her in any other place
   d. As regards the woman, she must know him to be married.

You can state that you don't know he was married as a defense and as long as you didn't live under one roof even for days then it is not considered concubinage. Even with your pregnancy, that is still not considered as proof that you cohabited together.

Another option for you, together with your legal counsel, is to strike a deal with the wife. She can file violence against women (psychological violence) against her husband and you will cooperate fully with the wife in exchange for absolving you from all charges.

Given the fact that you were a minor when you had a relationship with your ex, you have a more likely chance the judge will believe you that you were unaware that he was married. You can also ask for testimonies from those who knew your relationship that your ex deceived all of you into believing he was single.

Dami pa po nya sinsabi ng lung anu ano. Bastos po sya mag approach. Kahit namn po sino gawin sa sayo ang ganung way hindi ka po gaganahan magbayad. May right po ba yung friend ko na magfile or iblotter yung  naniningil sa knya. Kasi sbi pa pag di daw po nagbyad ipapabarangay daw po. Sabihin na po natinay kasalanan yun kaibigan ko kasi may sya.
