Good day! Anyone please help me. I cannot get an NBI clearance because my name is on hit list. My previous company is owned by a Foreign National, and when he applied for a corporation to Security Exchange Commission, he used some Filipinos working in his company as dummies because a foreigner cannot own 100% of the company. 4 other Filipinos including myself became members of the corporation. Few years later, one of his investors, filed a
case against our foreign boss for not allowing him to check some financial reports - the complainant claimed it is a violation of SEC 74 in relation to SEC 144 of the corporation code of the Philippines. When I checked about the status of the
case, it is already in Regional Trial Court level and we need to post a cash bond of 10,000 and appear in court hearings. The
case was filed in 2012 and I never knew about this since I am not working with the company anymore, I did not receive any communication from the complainant nor the Regional Trial Court. I only found out now that I am applying for an NBI clearance, I was greatly surprised I have a certain
case. I went to the court to supposedly post a bail, however, the in charge said among the 5 people who were allegedly accused, my name has been crashed out with a signature on the side, and I was not included in the issuance of alias warrant. The RTC person said there was a typographical error, I should be part of the warrant, they will amend the document to include my name, issue a new warrant, then I can post a bail. WHAT SHOULD I DO THEN? WAIT FOR THE WARRANT TO BE ISSUED AND THEN POST A BAIL? AND IF I POST A BAIL, WILL I GET CLEARED TO NBI AND GET A CLEARANCE? OR FIND OUT THE REASONS WHY MY NAME HAS BEEN DELETED IN THE FIRST PLACE THAT'S WHY I WAS NOT INCLUDED IN THE WARRANT? My problem here is I don't know if I can afford a lawyer and bring him to the court to appeal. I don't know how much it would cost me. But I am sure I can pay for the bail of 10,000 if the warrant will be issued. Should I just wait for it? PLEASE I NEED SOME ADVISE
