Employer is harassing me to pay them way more than my contract bond

Hi everyone. I was wondering if anyone could help me with my situation. I've recently resigned from my job a month ago. I have a contract bond amounting to almost 260,000. Based on my contract, the training will be for 2 years then I am required to render additional 2 yrs of service after the training. Failure to do so will require me to pay the pro-rated amount based on the number of unserved years with the company. However, I have recently received a demand letter from the legal department asking me to pay the company almost 2.6M after 5 days of receipt. What should I do? The contract said that the 260,000 is for the trainings that they have paid in advance for us. But I never received any trainings for the 13 months that I have stayed with them. Your advice will be very helpful and will be very much appreciated. Thank you!

My manager demands that I return all the salary that I have earned for my whole stay in the company. Even with my salary for the past 13 months, I wouldn't even reach 1M!! Is there anyway I could fight them back? Do I have a case against them for harassing/bullying me? Thanks

You have no choice/option right now but to defend yourself. It is assumed that your employer is charging you for 'damages'.

Just ignore them. You will only pay these 'damages' if there is an order from a competent court. Meaning, they need to file a case against you first and have the courts decide. In this moment and on that venue, you are then required to defend yourself. Tell the court everything and oppose their claim for damages. You need file a case against them kasi gagastos ka pa. Hayaan mong sila magdemanda sayo para ma-protektahan mo yang sariling sa korte.

Remember, ONLY a competent court can order you to pay. And they have no right to demand your salaries back. Even the courts CANNOT demand you to return your salaries as this is a violation of your to earn. Know your rights, protect it.

Thank you! How about the demand letter? Should I send them a response letter? I wrote a draft asking for a justification as to how they came up with the 2.6M.

Excuse po, pano po pala pag nagpursue si employer sa case for "damages", ano po kaya magiging
reflections ko pag dating sa bagong papasokan kong company?

Wala naman. Civil po ang damages at hindi siya Criminal Case na pwedeng maka-apekto sa record mo.

I am a civil engineer who sub-contracted a building construction for labor only or by unit rate payment, sample per cubic meter of concrete in place, per kilogram of steel bars fabricated and place, per square meter of formworks in place from a general contractor then I sublet it to another subcontractor or shall we call it pakyaw labor to certain Foreman/contractor. He is now the one directly in-charge in hiring his workers by daily compensation and others by pakyaw labor I dont know how he manage it. My responsibility is to pay him the accomplishment he had completed base on the unit agreed upon between us. Her comes the problem every weekend they submit an accomplishment report which I also submit to the general contractor for evaluation/verification and payment which turns out be short of what is needed to pay for the daily wages of his workers. without the control over how much was his payroll because our contract is pakyaw or labor by result. The foreman/subcontractor together with some of the workers went to DOLE to complain for under payment. Please give me an advise on what to do legally. Thank you very much.
