Good day!

Tanong ko lang po kung ano pwede gawin dito.

Sometime around April nagbigay ng salary increase ang company ni "Employee X" na pinagtatrabahuan niya. From 30K naging 40K sweldo niya until this month. Nagbago rin yung nakareflect sa payslip niya na monthly compensation which is 40K. Now, kahapon kinausap si "Employee X" ng employer niya na nagkamali daw sila at wala dapat siyang salary increase this year. Pinapabalik sa kanya yung naibigay nang sweldo sa kanya starting April. May laban ba siya just in case na ayaw niya ibalik yung money since si company ang nagkamali nun at hindi siya ininform kaagad. In good faith niya naman tinanggap yung money knowing na may increase siya since nag-iba yung nakadeclare na compensation sa payslip niya. Another thing, nagastos niya na yung pera.

Should "Employee X" return the money o ilalaban niya? Payag naman siyang ibalik sa dating sweldo niya which is 30K monthly pero di niya na maibabalik yung naibigay sa kanya since nagastos niya na.

employee x has to return the money. the most he can ask is for a payment scheme para hindi biglaan.

except nalang kung may memo or contract syang natanggap re dun sa pay increase.

On the concept of 'Unjust Enrichment' under the Civil Code, Any person, who at the expense of another, unjustly enriched himself, has the duty to return the same.

This is an equitable principle that no person should be allowed to profit at another's expense without making restitution for the reasonable value of any property, services, or other benefits that have been unfairly received and retained.

So, kahit in good faith pa siya, kailangan niyang ibalik ang pera na di niya dapat natatanggap. Kung nagastos na niya ang pera, pwedeng ikaltas ng employer sa next pay/s ang amount na kailangan niya ibalik.

Documented ba ang salary increase - memo or announcement? O biglang lumaki na lang ang sweldo nya?
