may cooperative na nagkautang sa amin for almost a year now na hindi pa nagbayad.may inissue na cheque pero wla namang fund.ano po bang legal aksyon ang pde nming gawin sa kanila? hindi rin sila nagpapartial payment kahit paunti unti mn lng sa loob ng isnag taon. they just keep on promising to us na magbayad pro wla kaming natatanggap.

can a demand letter be legal if it does not have a letter head, grammatically wrong sentences and an inserted letter using a ballpen?

Can a person file a case in Vigan if she lives in Manila and the event of unpaid debt happens in manila as well?

1) as long as the demand is understood, it can be considered a demand.

2) if she can prove residence in vigan, then the case can be filed there.

Will a pdc still gain interest if it the account is closed already?

Can you be sued for issuing PDC then had your account closed, yet the person to whom the checks were issued was notified by the owner of the checks?

what do you mean? the amount on the check does not change, but if the obligation has interest, it continues.

yes, you can be sued for a criminal case of bp 22 for issuing a bad check regardless if you informed the payee.

yes po. formal coop po. hindi po nmin denipisito ang cheque kasi po na inform nmn po kami na wlang sufficient fund po ung acct na un. . ung cheque inissue lng po pra lng maging legal na may utang cla sa amin na ganung amount po. pro sa napag usapan nmin, babayaran nla po in 1mo. kaso lng dw po kya d cla makapagbayad til now kasi d pa nla nakolekta din ung mga pautang nla. .kaso sa side nmn nmin mag 1year na kasi ngaung feb ang utang nla sa amin n walang partial payment mn lng kaming natatanggap. .sinisingil nmn po namin cla every month, pro puro promise lng. .wla kaming written agreement po about sa interest and due date. .verbal lng po lahat. .last year lng po 286k na po utang nila. .after 1 yr po umabot na sa almost 390k. nagpa issue aq ulit ng cheque po sa bago nming computation including interest , kaso lng sabi nila close npo daw checking acct nla. it means po,wla na kming pinanghahawakan na ganung amount na utang nla sa amin. ano po ba dapat nming gawin? may habol po ba kami sa kanila na pabayaran ang interest for 1year kahit na wla kaming written agreement? and paano po ba cla mapwersang magbayad? kalmado lng po kasi cla,pakapalan mukha na lng ang nangyayari kasi po. kami kasi po namomroblema sa utang nla sa amin. please help us po.

your remedy is to file a civil case for collection. unfortunately, the check is already stale so you can't deposit it anymore.
