Arresto Menor

i got pregnant 4 years ago, i told my ex bf about the pregnancy but he dont believe it. he was even told me na "makakagulo kayo sa buhay ko" so i decided to break up with him after all the words that he told me. kahit nakipagkita ako s knya to prove that im pregnant but nothing happens.. after that meet up i found out na dalawa kmi pinagsabay nya.. since the girl can bring him to US and he already chose that girl.. i decided to stop the communication with my ex bf since it is no good anymore in my health. and continue with my like..

after 4years, i suddenly receive a message from the father of my daughter that asking "if totoong anak ba daw b nya?" someone send him a picture of me and my daughter thru facebook messenger.. now he asking for a visitation rights but the child is only 4years old and didn't knew that he was her father.

my question is:

1. hindi namin (my parents) nilagay name nya sa birth certificate ng bata, may rights pa ba sya sa bata?

2. gusto nya makita ung bata? but may effect ba sa bata when if we allow yung gusto nya? or can i and my parents decide on what age he can meet the child?

3. kung may cases b na pwde ifile saknya kpg namilit sya mkita ang bata? since namimilit sya na mkita ang bata.. he even threat me na gagawa sya ng way to do what ever he wants just to see the child?

the father of my child have already family in US.

thank you

HI,

I am quoting your questions below in order to properly address them.

1. hindi namin (my parents) nilagay name nya sa birth certificate ng bata, may rights pa ba sya sa bata?

Since hindi siya nakalagay sa birth certificate ng bata, legally wala siya karapatan unless patunayan niya na siya nga ang ama.

2. gusto nya makita ung bata? but may effect ba sa bata when if we allow yung gusto nya? or can i and my parents decide on what age he can meet the child?

Yes, psychologically speaking, it is healthy for a child to know both of her parents. For this, please consider the welfare of your daughter, not what you and your parents think. The fact that the father wants to be present in your child's life is a positive thing. But then, it is your decision pa rin.

3. kung may cases b na pwde ifile saknya kpg namilit sya mkita ang bata? since namimilit sya na mkita ang bata.. he even threat me na gagawa sya ng way to do what ever he wants just to see the child?

It depends on what he does. If he could prove that he is the father, he has visitation rights under the law.

Regards,

Atty. Katrina
