Hi, I just want to consult you guys regarding my resignation from my previous company last July 19, 2016. I worked there for more than a year as an accounting staff. My employer did not give me an employment contract to sign for when I got hired. But still, I completed my 30 days notice. My problem is they won't give me my salary for the last cut-off and my backpay unless I completed my turn-over. They are so strict when it comes to that matter to think that there was no organize records given to me because the former employee who I replaced stopped attending to work for a couple of months before i got hired for the same reason of strict checking of turn-over. They always check every details of my turn-over. It will take me more than a month to finish it but I couldn't extend it because I already started for my new job.  Is it still possible for me to claim my backpay? You see, this company requires employee to attend to work during holiday but not giving double-pay to employees. They also don't give benefits like SSS, Philhealth and Pag-ibig to contractual employees. Thanks in advance.

talagang kailangan mag tender ng 30 days kahit walang contract. meron bang records or any info that you haven't given them already?

Ntapos q n po ung 30 days notice but the problem is they won't give me my backpay unless ung turn over q ng files e ndi p ntatapos. Palaging may pnapabago s format ng turn over q. They were so strict in checking n ndi sapat ang 30 days pra mtapos. Palaging may nkikitang mali pag ngchecheck.

Hi! I have the same problem. I worked sa hotel as housekeeping supervisor for 3 years nung nag 2nd yr ako dun lang ako nka sign ng contract. I passed my resignation sa HR it was received by her. The manager is out during that time. I rendered 15days for clearance transition etc etc.. pero parang wala lang sa HR petiks lang sila. I only got my last salary. And then now I am requesting sana for my COE pero ayaw nila akong bigyan. The HR said that she will wait for the manager to comeback. Nakakainis lang kasi pinapatagal pa.. nagrender naman ako ng 15days and sana kung may concern sila sana dun sa 15days na yun nagawa na pero petiks lang naman sila and now I can't get my coe coz mag dedecision pa ang manager. hayay.. and tama po bang wala akong backpay sa 3years ko? thanks po I hope po matulungan nyo ako..

almost a month na po akong resigned or natapos ang 15days q pero til now ayaw parin nila akong bigyan.. lahat naman na dapat ibigay sa kanila na records andun na po lahat....

anong backpay ang hinihingi mo? salary ng last cutoff? or 13th month and tax refund ba? normal lang ang one month or more to get yung final pay. kasi it usually takes 1 month para sa mga clearance. after that pa nila usually process yung mga makukuha mo

File a complaint sa DOLE. That way mapapabilis yung release ng backpay mo.
