My marriage was declared null and void and in effect, my 2 kids (1 minor) became illegitimate. The court further ordered that they have to adopt my surname instead of their father's surname which they have been using since they were born.

Can my children retain their father's surname despite the court's order? Is RA 9255 applicable to this case?

what was the basis for the declaration of nullity?

yes, ra 9255 is applicable but the father has to issue an authority to use his surname.

i cant remember anymore but it definitely costs less than P200,000. I made it on staggered payments.
But now that i know the process, i should have availed the services of PAO. Nullification is a simpler process than the Annulment, that is, if you have grounds for nullity.

that's right. the ground has to exist in the first place, and if it does, 200k is indeed a bit pricey.
