Hi,

I just need a legal advise regarding my parents property. The name on the title says "name of my mother" married to "name of my father". My mother acquired this property when she was single. Is this a conjugal property?

Also this property has not been transferred to my name because of the inheritance tax. My father had another family after my mom died and they want to get their part from that property. Oh, btw, my father passed away already, so I need your advise

Thank you.

It depend of which year they married. I have forgot which year it changed from being separate to conjugal. You can search yourself Smile someone else answered that more detailed recently in an other topic.

If they married after that year, I can tell you roughly what their share is, if you tell
/how many children your parents got together
/how many children your father got in the newer marriage
/and are there any illegimite children. If so how many?

if the property was acquired before she was married in 1978, then it should be considered her sole property. however, if this was so, why is it registered as her being married? why was there a delay in registration?

1978. As atyLLL say it's your mother's. Then them in the other family have NO right to the property.

I asume your father brought his things when he left.
To be FORMAL the children he got later, have only right to HALF as much as you from your FATHER, but perhaps you can SKIP that claim to reduce the arguing.

just be sure that the facts you are stating are correct and can be proven by evidence.
