Bp22 estafa

A friend of mine invested on our business. We had an agreement but no formal contract. Just a paper stating that I recieved 600t as investment to be loaned to our employees with certain interest but not even notarized. That was 1999. Year had passed. He renewed it and it's covered by pdc. Some was good some were bad. The business closed and I was oblidged to shoulder the debt. I tried settle it each and every month. We transferred residence and I wasn't able to communicate with them for awhile. But when had a chance I met up with him and gave my new address. I worked in another country and when I came back 1 yr after I gave him the car I bought to lessen the amount I owe. Some cash but it was channeled thru my other friend. God knows if he remits it or what. Even the car has no acknowledgement receipt. Anyway once in awhile I remit payment but last year I was able to send couple of thousands. Then the other day my friend informed me that he got an old check of mine and it's not dated. He deposited it and now he filled bp22 and estafa in las pinas and nbi. What am I supposed to do? I'm about to board a ship next month. And I might not be able to work because of this. Please help me. Thank you very much

will you be able to provide proof of your payments? did you receive a subpoena from the prosecutor's office and/or the nbi?

Good morning atty. Ask lang po ng advise. Last 2002 my my friend got a loan and as collateral she issued check and able to pay the last 3 checkk which amounting to 2750php each. in 2005 the lending company filed a case agains her for 3 counts of bp22. Now shes back in the country and as respect to the lenders she went back to them and wants to pay off the remaining balance. Apparentlyit was filed in mtc. According to the docs she had from mtc the lender calimed was 8750 plus the filling fee. but when sh talked to the lenders to settle the 8750 amount, the lender compute a charges in the amount of 75k plus for 8750 balance. She negotiated and the amount was lowered down to 42k plus, it is stil a big amount for 8750 balance. Please advise on what is the best thing to do since 42k is almost 300% interest. According to the lender, she computed the interest fromm 2005 upto feb or 2011 for 5% interest every month. Para pong hindi na makatarungan na bayaran ang ganun kalaki sa halagang 8750. Pa advise naman po ng pwedeng gawin ng frined ko. Salamat po ng marami.

i recommend she files bail if required by the court then try to settle during mediation.

Atty Thanks for the answer. Id like to ask coz until now there's no subpeona that was mailed. What does that mean? What if they send it in our old address? Is it possible? Im on the hdo list in immigration but its because of similar name. Im going to the rtc to get a cert that its not me. If they filled the case on me will i be hold again when i try to leave this march? Thank you

sdrawde, mere filing of the case does not automatically get them an HDO, but they may be able to get a watchlist order which is good for 60 days.

If they got me on the watchlist will i still be able to travel? And if a case was filled against me will it reflect my nbi clearance? On another topic my van was pulled from me due to non payment of the business loan. My last payment was sept. A letter from the sheriffs ofc stating that my van will be auctioned last feb14. I was talking to the banks legal agent and i was adviced to pay the full amount balance for me to get the car. Is it really like that. I cant give like a certain amount to hold it then pay it monthly till i finish the remaining balance. Thanls atty its a big help

if you're on the watchlist, you will not be allowed to leave. mere filing of the case will not immediately result in an nbi record. it will be when a warrant of arrest is issued.

you should have dealt with the bank sooner. you have a chattel mortgage. it probably states the can get the car and you agreed to it.

Is there any means for me to know if im in the watch list. So watch list amd hdo are the same? With regarda to the van. It means i wont be able to get it unless i agree with their legal dept. Thank you very much atty.

Hi po, gusto ko pong malaman kng pwede po ba akong mag travel ng abroad kahit po na kng for example meron pong my nag file ng case sakin. pero indi naman po ako na arraign, then last may 2008 I was filed a case of bp22 is it possible po na mag reflect po yun sa immigration? worry po kasi ako baka hindi ako makaalis with my Family.

Then yung sa bp22 nga pala na case na dissmissed na po pla yun atty. so baka po kasi my record yung immigration through internet.

cassy, to be sure you can check with the Bureau of immigration if you are on the derogatory list.

Atty ive been waiting for the subpeona if they really filled the case but theres none up to now. I got the clearance from the immigration. Is it automatic that the hdo will appear even if you filed a not the same person clearance from a different case. Do i really have to secure an nbi clearance to travel. Thanks.

it should be automatic, BUT to be sure, bring your documents.

no, you do not need an nbi clearance to travel, but it is required by the POEA if you are going out as an ofw

Actually my docs are all complete except for the nbi which the crewing agency didnt ask for. will the airport immigration officer ask me to present him and because of this will they prevent me from leaving. Thanks Atty.

Atty ask q lng po kz kukuha sana aq ng nbi clearance then they told me that there's a case filed against me, estafa daw po. i know 8 kz me inutangan aq and d q pa nababayaran. if that is really you, then probably a warrant of arrest has already been issued. you really should try to check out this case and find out what court it is filed. the nbi will have the info
