Hi to all..
Year 2010 since ngpareserve kmi ng isang town house unit. May mga receipt po kmi ng mga payment on reservation. Wala po kasing downpayment kaya madmi ng.aavail. Kaso pinatigil po ang bentahan and pagprocess for Pag.ibig since ngkacase po sa lupa ang developer. This year lang po namin nalaman na my iba na daw pong buyer ung unit namin without any notification from the developer or agent. Last year lang ngre.open for selling at Feb this year lang nkuha ng iba ang unit nmin. Ofw po kaya wla plagi. kami na ang pinapapipili ng ibang house unit ngaun. Pero syempre po iba na ang price ang location na ibbgay.mas mahal at mga dulo na. Almost 6years po ang inantay namin tpos gnun na pla.Bka my naka.experience na po ng ganito sa inyo?Ano po kayang advice or legal action or charge ang applicable sa ganito para mkuha ulit nmin ung unit?

Reservation fee mam.. wala kc po syang DP or equity. Pag.ibig po ang ggmitin sa rent to own. Ang nagyari po kc, nalaman po namin na ngkaron ng case ung developer sa land na naooccupy kung saan kasama ang unit namin kaya pnahold muna ang processing po. Inantay lang po nmin ma-clear ang case bago ipagpatuloy ang process sa pag.ibig.

Once lang po ung bayad nmin sa reservation fee mam, then after nun ska po cnbi na my case daw ung lupa.

Reservations are usually non-refundable and non-transferable. However your case is different. Were you asked to provide documents for filing? Did you sign any contract? What documents do you have?

It's been so long though, 6 years. Write a letter to the developer, asking them to reinstate your account. They have to answer. It may take time, but if they refuse to, they must write a reason for their refusal. After that you may go to HLURB.

We have the proof of payments for reservation (receipts) and their computation. We provided the documents they asked for processing of HDMF last october 2010.
I went to their office and spoke directly to one of their sales coordinator. They said they cannot track down our records, but he cant deny that the proof of payments I showed him were authentic. I think keeping track of the consumer's records is their responsibility mam.
The coordinator kept giving me the least choice of choosing another unit. However, I think mam the increments now will be applied to us if just now we will avail a unit.
I already wrote a letter of complaint addressed to the developer. I am hoping and praying for the most favorable response mam.
On the otherhand mam, what can HLURB do in this kind of matter?
