Gusto ko lang po mag consult sa inyo and manghingi ng legal advice regarding the current situation ng friend ko. Here's the circumstance:
She's a local government employee on a permanent position. Due to her dismay and no trust to the administration of the office where she works, she decided to seek employment abroad. Luckily, she got hired and was asked to personally submit all her documents to the company overseas.
She went to overseas even her not resigning in the government office where she is at that time employed.
She's a public school teacher under the local government so technically, she is under the employment of that LGU. She went abroad since its vacation (as her privilege being a public school teacher). Since her contract is about to start this July, and the Visa granted to her will cover the entire time while waiting for her working permit and documents, she just decided to stay overseas.
Unfortunately, the school sent a letter to her home address asking her to report the following day upon receipt of the letter. It says in the letter that reports have reached the school that she seeks employment abroad and her non-appearance the day after receiving the letter will mean that the information about her is true.
She's asking if there will be legal implications that she will be encountering by doing this? She is planning to submit her resignation letter through her Aunt. She has no pending cases criminal nor administrative.
I hope that you can shed light on this matter and we will be very grateful for your legal advice.
Thank you very much and more power!
