Hello Everyone,

Please help on this matter:

We have a Systems Engineer who have a training bond for two years and now intends to resign. He found out that the training cost indicated in his contract was not the actual cost of the training he attended (it is lesser than the contract cost). His information was coming directly from the training provider by giving him the copy of the actual Purchase Order made by the company. Now that he is leaving the company, he is demanding to pay only the actual training cost. The management however, wants to be firm in making him pay the value indicated in the contract that he signed.

Given the scenario, what is the best thing to do? Can we just compute according to the actual training cost or can we insist him to pay the amount in the contract? What can be the repercussion?

Your advise will be very much appreciated. Thank you in advance!

Dun sa contract nya, nakasulat ba na yung training cost ay para dun sa specific training na yun? For example did it mention na this is for the training from Magnolia training school? If not specific pwede mo parin charge yung amount indicated in the contract.

He can file a labor case against you. the arbiter will decide if tama yung pag charge or if hindi. Off course you can just charge him the actual amount thats management prerogative as well. I would advise doing so as you really shouldn't profit from training.

Nakaspecify nga sa contract namin kung sino ang nagprovide ng training kaya nakuha nya specific amount.

Sabi ng management dapat daw binding ang contract namin kaya kung ano yung napirmahan, dapat iyon ang ichacharge sa kanya.

Ano po ba ang best practice ng ibang company pag sa IT people na katulad ng mga ito?

If specific ang provider, he might have a case against you if he files. Hindi kasi dapat pagkakitaan ng company ang empleyado sa training.

If "training" lang kasi nakalagay sa contract pwede pa justify ng company yung costs sa supervisor and peers nya during the training period
