Kung 2nd contract mo lang yan ay pwede pa nilang gawin yang evaluation na yan. Ang ipinagbabawal ng batas ay ang paulit-ulit na gawing 'contractual' ang empleyado. Kung paulit-ulit kasing 'contractual' ang isang empleyado, pwede itong ma-consider na regular employee kasi sya ay "engaged to perform activities which are usually necessary or desirable in the usual business or trade of the employer". Kaya kung 2ng contract mo pa lang iyan ay pwede pa nilang gawin ang evaluation.
